An Act to Establish
a Commission Respecting
the Heritage of Nova Scotia's Capital
Be it enacted by the Governor and Assembly as follows:
1 This Act may be cited as the Provincial Capital Heritage Commission Act.
(a) four persons appointed by Halifax Regional Municipality, two of whom may be members of the Council of Halifax Regional Municipality, one of whom is the individual who chairs Halifax Regional Municipality's Heritage Advisory Committee and one of whom is the member of Halifax Regional Municipality's planning staff designated to deal with heritage matters;
(b) six persons appointed by the Governor in Council, four of whom are residents of Halifax Regional Municipality not directly employed by any level of government and with a demonstrated knowledge of and interest in heritage matters, one of whom is a member of the Advisory Council on Heritage Property and two of whom may be employed by the Department of Transportation and Public Works or any other agency from time to time charged with responsibility for Government-owned properties; and
(c) one person appointed by the federal Department of Canadian Heritage.
(a) subject to Section 5, to create and publish an inventory of publicly and privately owned buildings of heritage value in Halifax Regional Municipality, including and specifying those that could be used for public purposes;
(b) to liaise generally with the federal Department of Canadian Heritage and any other federal agency, as appropriate, regarding their plans for land development that might have an impact on heritage in the capital region;
(c) to liaise generally with Halifax Regional Municipality regarding plans for land development that might have an impact on heritage in the capital region;
(d) to consider ways to protect municipal heritage properties, provincial heritage properties and national historic sites by controlling development in their peripheral areas;
(e) to advise the Minister of Tourism, Culture and Heritage, no less frequently than annually, and to publish an analysis of costs and benefits for acting on clause (a); and
(f) to advise the Minister of Tourism, Culture and Heritage, no less than annually, and to publish an analysis of costs and benefits for acting on clause (d);
4 In carrying out its mandate, the Commission shall have regard to municipal land-use policies and laws, Provincial policies and laws, federal policies and laws and international agreements and conventions.
5 The moneys required for the purpose of this Act must be paid out of moneys appropriated for that purpose by the Legislature.
