Explanatory Note

This Bill

(a) prohibits signs and materials promoting or advertising the sale of tobacco or tobacco products, prohibits the display of tobacco or tobacco products except as permitted by the regulations and prohibits a place that does display tobacco or tobacco products from permitting a person under the age of 19 years to enter that place;

(b) requires the storage of tobacco and tobacco products in accordance with the regulations; and

(c) prohibits the sale of tobacco or tobacco products in establishments designated by the regulations.

An Act to Amend Chapter 14
of the Acts of 1993,
the Tobacco Access Act

Be it enacted by the Governor and Assembly as follows:

1 Section 5 of Chapter 14 of the Acts of 1993, the Tobacco Access Act, as amended by Chapter 12 of the Acts of 1999, is further amended by adding immediately after subsection (2) the following subsection:

(2A) No vendor or employee of a vendor that displays tobacco or tobacco products in an establishment shall permit any person under the age of nineteen years to enter or be in that establishment.

2 Subsection 9(2) of Chapter 14 is repealed and the following subsection substituted:

(2) No person shall display or permit the display of any sign or material promoting or advertising the sale of or otherwise respecting tobacco or tobacco products except as prescribed by the regulations.

3 Section 9A of Chapter 14 is repealed and the following Section substituted:

9A (1) No vendor or employee of a vendor shall display or permit the display of tobacco or tobacco products except as prescribed by the regulations.

(2) No vendor or employee of a vendor shall store tobacco or tobacco products except as prescribed by the regulations.

4 Section 9B of Chapter 14, as enacted by Chapter 12 of the Acts of 1999, is amended by

(a) striking out "or" at the end of clause (a);

(b) striking out the period at the end of clause (b) and substituting "; or"; and

(c) adding immediately after clause (b) the following clause:

(c) an establishment designated by the regulations.

5 Section 12A of Chapter 14, as enacted by Chapter 12 of the Acts of 1999, is amended by

(a) adding "vendor who contravenes or whose employee contravenes Section 9A, every" immediately after "Every" in the first line; and

(b) adding "and every establishment designated in the regulations that sells tobacco or tobacco products or whose employee sells tobacco or tobacco products in that establishment" immediately after "9B" in the fourth line.

6 (1) Subsection 13(1) of Chapter 14 is amended by adding immediately after clause (a) the following clause:

(aa) designating establishments for the purpose of Section 9B;

(2) Section 13 of Chapter 14 is further amended by adding immediately after subsection (1) the following subsection:

(1A) A regulation may apply to all vendors or to a class of vendors and there may be different regulations for different classes of vendors.

7 This Act has effect on and after March 31, 2007, upon the Governor in Council so ordering and declaring by proclamation.
