Explanatory Notes

Subclauses 1(1) and (2) make the cap on assessments automatic rather than requiring an application.

Subclause 1(3) changes the deadline for the review of the cap on assessments by the Minister of Service Nova Scotia and Municipal Relations from before April 1, 2007, to before October 1, 2006.

An Act to Amend Chapter 23
of the Revised Statutes, 1989,
the Assessment Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 45A(9) of Chapter 23 of the Revised Statutes, 1989, the Assessment Act, as enacted by Chapter 10 of the Acts of 2004, is amended by striking out "where required by the regulations or" in the second line.

(2) Section 45A of Chapter 23, as enacted by Chapter 10 of the Acts of 2004, is further amended by adding immediately after subsection (10) the following subsection:

(10A) Notwithstanding subsections (9) and (10), no application is or may be required in order that this Section apply.

(3) Subsection 45A(13) of Chapter 23, as enacted by Chapter 10 of the Acts of 2004, is amended by striking out "April 1, 2007" in the first line and substituting "October 1, 2006".
