Explanatory Note

This Bill amends the Employment Support and Income Assistance Act to ensure that

(a) the Government does not consider the new $100.00 per month federal child-care allowance as income for the purpose of calculating assistance under the Act; and

(b) the Government does not seize or garnish the allowance due to an overpayment of assistance under the Act.

An Act to Amend Chapter 27
of the Acts of 2000,
the Employment Support
and Income Assistance Act

Be it enacted by the Governor and Assembly as follows:

1 Section 3 of Chapter 27 of the Acts of 2000 is amended by adding immediately after clause (c) the following clause:

(ca) "federal child-care allowance" means the allowance of one hundred dollars per month for child care set out in the federal budget tabled in the House of Commons on May 2, 2006;

2 Chapter 27 is further amended by adding immediately after Section 7 the following Section:

7A The federal child-care allowance must not be considered when calculating or determining the assistance payable pursuant to this Act or the regulations.

3 Chapter 27 is further amended by adding immediately after Section 9 the following Section:

9A The federal child-care allowance is not subject to seizure or garnishment in order to recover an overpayment of assistance payable pursuant to this Act or the regulations.
