Explanatory Note

This Bill requires the semi-annual reporting of any acquisitions of supplies by departments of government that are made under exceptions or exemptions from standard government procurement practices.

An Act to Amend Chapter 188
of the Revised Statutes, 1989,
the Government Purchases Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 188 of the Revised Statutes, 1989, the Government Purchases Act, is amended by adding immediately after Section 6 the following Section:

6A (1) All departments of government within the meaning of the Public Service Act shall immediately report to the Agency

(a) any acquisitions of supplies; or

(b) any contract for services,

that are made under any exceptions or exemptions from standard government procurement practices.

(2) The Agency shall, on a semi-annual basis, prepare reports setting out all acquisitions and contracts referred to in subsection (1) and shall deliver the reports to the Minister on or before the first day of April and the first day of October in each year.

(3) The Minister shall, within seven days of receipt of a report referred to in subsection (2), table the report in the Assembly if the Assembly is then sitting or, if the Assembly is not then sitting, file the report with the Clerk of the Assembly.
