Explanatory Notes
Clause 1 amends the Off-highway Vehicles Act to provide that a parent or guardian can no longer apply for a permit for an off-highway vehicle for a person who is younger than fourteen years of age.
Clause 2 amends the Act to prohibit the operation of off-highway vehicles by persons younger than fourteen years of age.
Clause 3 adds conditions to the Act respecting the operation of off-highway vehicles by persons between the ages of fourteen and sixteen years and creates an offence respecting owners or operators who permit those younger than sixteen to operate such a vehicle in contravention of the Act.
Clause 4 adds regulation-making powers respecting youth-class learner's licences, training and the operation of vehicles by persons between the ages of fourteen and sixteen.
An Act to Amend Chapter 323
of the Revised Statutes, 1989,
the Off-highway Vehicles Act
1 Subsection 3(2) of Chapter 323 of the Revised Statutes, 1989, the Off-highway Vehicles Act, is amended by adding "but at least fourteen years of age" immediately after "age" in the second line.
2 (1) Subsection 11(1) of Chapter 323 is amended by striking out "Except as provided in subsections (2) and (3), no" in the first and second lines and substituting "No".
(2) Subsections 11(2) and (3) of Chapter 323 are repealed.
3 Chapter 323 is further amended by adding immediately after Section 11 the following Section:
(a) the person who is under the age of sixteen years has a youth-class learner's licence issued pursuant to the regulations;
(b) the person who is under the age of sixteen years is under the direct supervision of a parent or guardian and within the sight of that parent or guardian; and
(c) both the parent or guardian referred to in clause (b) and the person who is under the age of sixteen years have successfully completed off-highway vehicle training prescribed by the regulations.
(2) A person who is an owner of an off-highway vehicle or who has control of an off-highway vehicle and who permits a person under the age of sixteen years to operate that vehicle in contravention of this Section or Section 11 is guilty of an offence and is liable on summary conviction to a penalty of not less than two hundred and fifty dollars.
4 Subsection 25(1) of Chapter 323 is amended by adding immediately after clause (c) the following clauses:
(cb) prescribing off-highway vehicle training for the purpose of Section 11A that is to be completed by
(ii) a parent or guardian who will be supervising a person under the age of sixteen years in the operation of an off-highway vehicle;
