Explanatory Note

This Bill adds to the Motor Vehicle Act regulation-making power to prevent muffler noise.

An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, is amended by adding immediately after Section 188 the following Section:

189 The Minister shall, by the thirty-first day of December, 2005, make regulations

(a) prescribing acceptable decibel levels for noise emanating from an exhaust system;

(b) prescribing an approved instrument for measuring decibel levels;

(c) prohibiting a make, model or type of muffler for use on a vehicle that fails to reduce noise below the prescribed level;

(d) prescribing the manner in which a police officer may examine a vehicle for compliance with regulations made pursuant to this Section;

(e) prescribing any actions a vehicle operator must take to comply with a police officer's examination;

(f) prescribing penalties for the violation of a regulation made pursuant to this Section;

(g) prescribing penalties for operators of an official inspection station or service and repair station that fail to comply with this Section.
