Explanatory Note

This Bill ensures that part of a railway line cannot be abandoned.

An Act to Amend Chapter 11
of the Acts of 1993,
the Railways Act

Be it enacted by the Governor and Assembly as follows: 1 Section 19 of Chapter 11 of the Acts of 1993, the Railways Act, is amended by adding "(1)" immediately after the Section number and by adding the following subsection:
(2) Notwithstanding subsection (1), the Board may not amend a licence to authorize the operation of a railway service over only part of the railway line over which the railway service was authorized to operate immediately before the amendment.
2 Section 41 of Chapter 11 is amended by adding immediately after subsection (4) the following subsection:
(5) For greater certainty, the owner or lessee of a railway line may not discontinue a railway service over only part of the railway line over which the railway service is authorized to operate.
3 Section 42 of Chapter 11 is amended by adding immediately after subsection (3) the following subsection:
(4) For greater certainty, the owner or lessee of a railway line may not abandon only part of a railway line.
