Explanatory Note

An employee in the public service is required to retire upon reaching the age of 65 years unless the Governor in Council directs that the employee be continued in the public service for a further period. This Bill eliminates this mandatory retirement.

An Act to Amend Chapter 377
of the Revised Statutes, 1989,
the Public Service Superannuation Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsections 16(1) and (2) of Chapter 377 of the Revised Statutes, 1989, the Public Service Superannuation Act, are repealed.

(2) Subsection 16(4) of Chapter 377 is amended by striking out "Notwithstanding subsection (2), contributions" in the first and second lines and substituting "Contributions".

(3) Subsection 16(8) of Chapter 377 is amended by striking out "is required or" in the third line.
