Explanatory Note

This Bill enables a court to order, pursuant to the Family Maintenance Act, one person to provide spousal support to another person not only in cases where the persons are of different sexes, which is now the case, but also in cases where the persons are of the same sex.

An Act to Amend Chapter 160
of the Revised Statutes, 1989,
the Family Maintenance Act

Be it enacted by the Governor and Assembly as follows:

1 Clause 2(m) of Chapter 160 of the Revised Statutes, 1989, the Family Maintenance Act, is repealed and the following clause substituted:

(m) "spouse" means a person married to another person and, for the purpose of this Act, includes two persons who are either of different sexes or of the same sex who, not being married to one another, have lived together in a conjugal relationship continuously for one year.
