An Act to Require the
Government to Develop Modern
Standards for Homes for Special Care

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Homes for Special Care Standards Development (1998) Act.

2 In this Act, "home for special care" means a nursing home or a residential care facility as defined by the Homes for Special Care Act.

3 Within six months of the coming into force of this Act, the Minister of Health shall

(a) for the purpose of developing modern standards for homes for special care, consult with

(i) administrators of homes for special care,

(ii) representatives of residents of homes for special care,

(iii) families of residents of homes for special care,

(iv) employees of homes for special care and their unions, and

(v) representatives of interested community groups;

(b) based upon the consultations, prepare guidelines for standards of care in homes for special care, including guidelines respecting licensing, funding, standards of accommodation, staff-patient ratios and all other matter relating to the care and well-being of the residents of homes for special care;

(c) based upon the consultations, prepare guidelines for staff requirements, qualifications, remuneration, safety, training and work environment; and

(d) table the guidelines in the House of Assembly.
