Explanatory Notes
(a) changes the composition of the Board of Directors of the Preston Area Housing Fund; and
(b) provides that a person who is a member of the Senate, House of Commons, House of Assembly, the council of a municipality, a school board or a village commission is disqualified from being a member of the Board.
Subclause 1(2) permits a person who is appointed to the Board to be re-appointed and a person who is elected to the Board to be re-elected but provides that a person may not be elected to the Board for more than two consecutive terms.
Subclause 1(3) removes gender-specific language from the Act.
Subclause 1(4) changes the quorum of the Board of Directors.
An Act to Amend Chapter 353
of the Revised Statutes, 1989,
the Preston Area Housing Act
Be it enacted by the Governor and Assembly as follows:
1 (1) Subsection 3(2) of Chapter 353 of the Revised Statutes, 1989, the Preston Area Housing Act, is repealed and the following subsections substituted:
(a) one person appointed by the Council of the Halifax Regional Municipality;
(b) two persons appointed by the Minister of Community Services;
(c) two persons appointed by the Minister of Housing and Municipal Affairs;
(d) two persons who are residents of the community of North Preston elected by those members appointed to the Board pursuant to clauses (a), (b) and (c);
(e) two persons who are residents of the community of East Preston, elected by those members appointed to the Board pursuant to clauses (a), (b) and (c);
(f) one person who is a resident of the community of Cherry Brook, elected by those members appointed to the Board pursuant to clauses (a), (b) and (c); and
(g) one person who is a resident of the community of Lake Loon, elected by those members appointed to the Board pursuant to clauses (a), (b) and (c).
(2A) A person who is a member of the Senate, the House of Commons or the House of Assembly or who holds an office to which that person has been elected pursuant to the Municipal Elections Act or the Village Services Act shall not be a member of the Board.
(2) Section 3 of Chapter 353 is further amended by adding immediately after subsection (3) the following subsection:
(3) Subsection 3(5) of Chapter 353 is amended by
(a) striking out "Chairman" in the first line and substituting "Chair"; and
(b) striking out "Vice-chairman" in the third line and substituting "Vice-chair".
(4) Subsection 3(6) of Chapter 353 is repealed and the following subsection substituted:
