An Act to Amend Chapter 55
of the Acts of 1963,
the Halifax Regional Water Commission Act
Be it enacted by the Governor and Assembly as follows:
1 Clause 10(a) of Chapter 55 of the Acts of 1963, the Halifax Water Commission Act, as enacted by Chapter 78 of the Acts of 1973 and amended by Chapter 3 of the Acts of 1995, is further amended by
(a) striking out "or" in the second line and substituting a comma;
(b) adding "or sewage-treatment facility" immediately before "owned" in the third line; and
(c) striking out "or sewer system" in the last line and substituting ", sewer system or sewage-treatment facility".
2 Section 27 of Chapter 55 of the Acts of 1963, the Halifax Regional Water Commission Act, is repealed and the following Section substituted:
(a) the Public Utilities Act does not apply to the ownership, operation, management or control by the Commission of any sewer system or sewage-treatment facility; and
(b) the Commission is not a public utility within the meaning of the Public Utilities Act with respect to its ownership, operation, management or control of any sewer system or sewage-treatment facility.
