Explanatory Note

This Bill amends the Correctional Services Act to require the use of prescribed restraints and other enforcement tools during the transportation of offenders.

An Act to Amend Chapter 37
of the Acts of 2005,
the Correctional Services Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 37 of the Acts of 2005, the Correctional Services Act, is amended by adding immediately after Section 88 the following Section:

88A (1) Whenever an offender is being transported pursuant to Section 88 or for any other purpose under this Act, the persons carrying out the transportation of the offender shall make use of restraints and other enforcement tools prescribed in the regulations.

(2) The moneys required for the purpose of this Section shall be paid out of moneys appropriated for that purpose by the Legislatures.

2 Subsection 94(1) of Chapter 37 is amended by adding immediately after clause (ba) the following clause:

(baa) prescribing restraints and other enforcement tools for the purpose of Section 88A;
