Explanatory Notes
Clause 1 expands the purpose of the Act to prevent prohibitions on the use of clotheslines outdoors at all types of residential premises.
(a) amends the definition of "clothesline" to include a drying rack; and
(b) adds a definition of "residential premises".
Clause 3 prevents restrictions on the installation, placement or use of clotheslines outdoors at any residential premises.
Clause 4 clarifies that reasonable restrictions on the installation, placement or use of a clothesline must be for safety purposes or to prevent damage to the common areas of a multi-unit residential building.
An Act to Amend Chapter 34
of the Acts of 2010,
the Clothesline Act
1 Section 2 of Chapter 34 of the Acts of 2010, the Clothesline Act, is amended by striking out "a single-family dwelling or on the ground floor of a multi-unit residential building" in the third and fourth lines and substituting "residential premises".
2 Section 3 of Chapter 34 is repealed and the following Section substituted:
- 3 In this Act,
(a) "clothesline" means a line, rope, wire, cord or drying rack used to hang laundry to dry;
(b) "residential premises" includes any house, dwelling, apartment, condominium, mobile home or other place that is occupied or may be occupied by an individual as a residence.
3 Subsection 4(1) of Chapter 34 is amended by striking out "a single family dwelling or on the ground floor of a multi-unit residential building" in the second and third lines and substituting "residential premises".
4 Section 5 of Chapter 34 is amended by adding "for safety purposes or to prevent damage to the common areas of a multi-unit residential building" immediately after "clothesline" in the second line.
