MR. SPEAKER: I would like to bring the House to order, please. We will begin the daily routine.

PRESENTING AND READING PETITIONS

MR. SPEAKER: The honourable member for Lunenburg West.

MR. DONALD DOWNE: Mr. Speaker, I beg leave to table a petition signed by 191 residents of Lunenburg County, to which I have affixed my signature. The operative clause reads as follows:

"The following signatures are in protest to the new ruling to remove all signs from the highways not pertaining to Tourism. This new ruling will result in a substantial loss of business opportunity.

We do agree that our province must be clean and respectable that it is necessary that all signs be properly designed and installed to enhance our communities and should in no way interfere with the visibility of highway signs or intersections.

We feel the term used as intersection might be more applicable to main highways such as the 103 and not secondary roads that service small communities in rural areas.

This new signage ruling is a major injustice both to the businesses which rely on roadside advertisement and to those needing their services."

RESOLUTION NO. 3814

MR. DARRELL DEXTER: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the MLA for Sackville-Beaver Bank loyally defended the Conservative Government when school budgets were to be slashed by $20 million and the new Cobequid Multi-Service Centre was repeatedly delayed; and

Whereas that Conservative MLA heard the public loud and clear when, at Friday's hearings, no one spoke in support of the government's half-hearted smoking legislation; and

Whereas that MLA correctly identified three problems: protection of workers' health, business requests for a level playing field and the value of a complete ban rather than half measures;

Therefore be it resolved that this House urge the Hamm Government to recognize that it has once again united Nova Scotians in opposition to a piece of smoke-and-mirrors Conservative legislation and to indicate that it is willing to support a ban on smoking in all workplaces.

MR. MANNING MACDONALD: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the 10th Annual Hip Hip Hooray walk will be held in Sydney on May 26th, with honorary chairperson Rita MacNeil leading the walk; and

Whereas the Hip Hip Hooray walk is held in aid of research into bone diseases and supports the continuing education of professionals and their patients; and

Whereas this event will feature patients from Cape Breton who have found new mobility through bone surgery;

Therefore be it resolved that all members of this House congratulate the planning committee on putting together the 10th Annual Hip Hip Hooray walk and wish them well in the upcoming walk.

RESOLUTION NO. 3816

MR. DAVID HENDSBEE: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Halifax Oland Exports topped the Opaskwayak Cree Nation Blizzard of The Pas, Manitoba, 3-1 to capture the Royal Bank Cup in the final game of the national Junior A hockey championship on Sunday; and

Whereas the Exports captured their first national Junior A title in front of over 3,000 fans at the Halifax Forum and lost only nine games during the regular season and playoffs, with a 21-1 post-season record; and

Whereas the Sunday game was the first tier 2 hockey championship win for a Nova Scotia-based team and the first national title game since 1988 for Jim Bottomley, the Exports' Coach for the past 21 seasons;

Therefore be it resolved that this House congratulate the Halifax Oland Exports and their Coach, Jim Bottomley, on their recent Royal Bank Cup victory, which transformed the Halifax Olands from tournament host into the Junior A hockey team with the most.

RESOLUTION NO. 3817

MR. WILLIAM ESTABROOKS: Especially a junior A fan, not a Moosehead one, but anyway.

Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Halifax Oland Exports, under the leadership of Coach Jim Bottomley, captured the Junior A Royal Bank Cup on Saturday - actually Sunday; and

Whereas B.J. Brown of Timberlea scored the winning goal in the 3-1 championship game at the Halifax Forum; and

Whereas this national championship is the culmination of many years of hard work and dedication;

Therefore be it resolved that this House of Assembly congratulate Jim Bottomley, coaches, players and fans of the Halifax Oland Exports on winning the Junior A Royal Bank Cup.

Whereas these awards were given to companies for their achievement in the successful prevention of workplace injuries;

Therefore be it resolved that all members of this House congratulate A Bek Drywall Limited, located in Lunenburg County, on being one of 20 companies in Nova Scotia recognized for their achievement of preventing workplace injuries;

Whereas the word "community" speaks to the very heart of Nova Scotia; and

Whereas on Saturday, April 27th, the residents of Maitland Bridge and surrounding area gathered at the Maitland Bridge Community Hall to celebrate the completion of their accessibility and renovation projects; and

Whereas the Maitland Bridge Community Hall has been a centrepiece of that community for decades;

Therefore be it resolved that the members of this House congratulate the Maitland Bridge Community Hall Society for their hard work and dedication on behalf of their community.

Whereas the member for Sackville-Beaver Bank wants his government to ban smoking in public places completely; and

Whereas that member will hopefully provide inspiration to his backbench colleagues to do the same thing as well, and speak out in support for his call for a complete ban; and

Whereas even a small groundswell of support from the Tory backbenchers might convince this government to change its milquetoast stance on banning smoking in public places;

Therefore be it resolved that this House congratulate the member for Sackville-Beaver Bank for having the courage to speak up against his government's flawed approach to stopping smoking in public places.

Whereas the Nakile Home for Special Care, located in Yarmouth County, was honoured last week with an Occupational Health and Safety Workplace Achievement Award; and

Whereas these awards were presented to 20 Nova Scotia companies as part of North American Occupational Safety and Health Week activities; and

Whereas these awards were given to companies for their achievement in the successful prevention of workplace injuries;

Therefore be it resolved that all members of this House congratulate the Nakile Home for Special Care, located in Yarmouth County, on being one of 20 companies in Nova Scotia recognized for their achievement of preventing workplace injuries.

RESOLUTION NO. 3822

MR. FRANK CHIPMAN: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the colours of the army's former Annapolis Regiment were paraded for the first time in 66 years by the West Nova Scotia Regiment, at Fort Anne, before their laying-up ceremony at St. Luke's Anglican Church last Sunday; and

Whereas the Annapolis Regiment, which can trace its lineage back to 1717, was first brought together in 1869 when local independent militia companies along the Fundy Shore were joined to become the 69th and 72nd Regiments, both of which were eventually amalgamated in 1898 as the 69th Annapolis Regiment, which itself was amalgamated with the Lunenburg Regiment in 1936 to form the West Nova Scotia Regiment; and

Whereas while the colours of the Lunenburg Regiment were laid up after it merged with the Annapolis Regiment, those of the Annapolis unit were turned over to the museum at Fort Anne National Historic Site where they stayed until they were recently put in storage, prompting the recent laying up ceremony;

Therefore be it resolved that members of this House pay tribute to the many sacrifices and selfless service of the brave soldiers who served in the Annapolis Regiment.

Whereas May 12th to May 18th marks Police Week in Canada; and

Whereas Police Week increases awareness and recognition of policing services while invigorating community and police partnerships; and

Whereas Canada remains one of the safest countries in the world and our police forces deserve praise for the great part they play in protecting our communities;

Therefore be it resolved that this House congratulate and thank our police forces during this Police Week for the exemplary job they do in working with our communities to keep Canada one of the safest places to live in the world.

DR. JAMES SMITH: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the superb Smoke-free for Life Program is not mandatory in the school curriculum in Nova Scotia; and

Whereas research shows that this curriculum could successfully reduce smoking among our youth by almost 10 per cent, saving lives and health care dollars of Nova Scotians; and

Whereas the Minister of Health has stated that he will discuss making the Smoke-free for Life curriculum mandatory in our schools with his colleague, the Minister of Education;

Therefore be it resolved that the Minister of Health update the House on any discussions to date that he has had with his colleague, and let us know whether or not we will see this program become mandatory in the schools of this province.

RESOLUTION NO. 3825

MR. CECIL CLARKE: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the University College of Cape Breton and the Nova Scotia Community College have been awarded a joint contract by ExxonMobil to provide advanced technical training at their Sydney campuses; and

Whereas 15 students from Angola will receive this advanced training which they will apply to the hydrocarbon discoveries being developed by an ExxonMobil subsidiary in Angola; and

Whereas the awarding of this contract reflects well on the collective training capabilities of these two post-secondary institutions and to their fast response in developing much-demanded petroleum programs; and

Therefore be it resolved that all members of this House congratulate UCCB and NSCC on collaborating to deliver this contract and acknowledge the valuable petroleum training programs they have developed for Nova Scotians and for students from around the world.

MR. FRANK CORBETT: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Catholic Women's League recently celebrated the 80th annual CWL convention for the Antigonish Diocese in Sydney Mines; and

Whereas approximately 300 women from parishes all over the diocese gathered for the convention to discuss issues and resolutions of concern to Roman Catholics; and

Whereas resolutions passed at the conference will be taken to the national convention of the Catholic Women's League;

Therefore be it resolved that members of the Legislature encourage groups like the Catholic Women's League to remain active members of their community and congratulate the CWL of the Antigonish Diocese on their successful 80 years of activity.

RESOLUTION NO. 3828

MR. TIMOTHY OLIVE: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Dartmouth Kiwanis Club, founded in 1943, annually participates in the provinces Adopt-A-Highway Program by cleaning the 5 kilometre highway section running from the Parclo through Waverley Road in Dartmouth and its members are about to embark on their Spring highway clean-up; and

Whereas the Adopt-A-Highway Program is an international roadside litter clean-up initiative and a Nova Scotia branch was established in 1997 by the Women's Institutes of Nova Scotia, the Lions Clubs and Clean Nova Scotia; and

Whereas each year in Nova Scotia more than 1,000 volunteers collect thousands of bags of garbage and over 100 sections of highway have been adopted, covering 700 kilometeres;

Therefore be it resolved that all members of this House congratulate members of the Dartmouth Kiwanis Club for their exceptional work in beautifying their community as well as all Nova Scotians who participate in the Adopt-A-Highway Program to help keep our province beautiful and clean.

Whereas the Minister of Education has no plans of making gym class mandatory for high school students even though recent statistics show obesity is on the rise in Nova Scotia;

Therefore be it resolved that the Minister of Education review her decision that will negatively impact Nova Scotians and make provision for mandating physical activity, including physical education, integral to the curriculum of our high schools.

Whereas the excuse made by this minister last year that she had not made the appointments was because she was not convinced that all students were aware of the vacancies, even though the minister was present when staff from the Department of Education informed representatives of nine student unions that applications were being accepted for vacant seats;

Therefore be it resolved that the Minister of Education take proactive steps to ensure that students from across the province are aware of the vacant seats now and that she recommend appointments for these agencies, boards and commissions in a much more timely manner than last year.

Whereas Pope John XXIII Church in Colby Village began a Lifeteen program in early 2001, under the guiding hand of Father David Poirier, that has grown from 20 to 100 teens, often supplemented by teens from surrounding parishes;

MR. SPEAKER: Order, please. Just before we get to the Government House Leader, it is the first time I have been back in the Chair since I was asked to make a ruling and I would like to pass on the findings of that ruling now, if you will just bear with me for a minute.

A point of order was raised in the House on Tuesday, May 7th, respecting a matter which occurred during second reading debate on Bill No. 128. This bill was moved for second reading by the honourable Government House Leader on behalf of the Minister of Service Nova Scotia and Municipal Relations. This in itself is not an unusual occurrence over the years in this House. It is usually done when the minister sponsoring the bill is unavoidably absent and the procedure has become a custom or usage of the House.

Following the motion for second reading, a member of the House entered the debate. Upon the member finishing his remarks, the Minister of Service Nova Scotia and Municipal Relations stood to enter debate. The issue was raised that if the honourable minister was allowed to speak he would, in effect, be closing the debate. I might point out that it was clear that other honourable members wished to join in the debate on the bill.

I therefore must rule that a valid point of order was raised and that the sponsoring minister - if I can call him that - does not have the right to join the debate except in reply when his or her bill is moved by some other member on his or her behalf. I trust this takes care of the matter.

RESOLUTION NO. 3852

I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Ladies Auxiliary of the Royal Canadian Legion provides important support and fundraising to each branch of the Legion;

Whereas the Armstrong Memorial Branch 19 in North Sydney recently hosted the annual Legion Ladies Auxiliary gathering in North Sydney; and

Whereas about 175 delegates from across Cape Breton, Guysborough and Antigonish got together to share news from each auxiliary and to meet old friends;

Therefore be it resolved that all members of this House acknowledge the role the Legion Ladies Auxiliaries play in making the Royal Canadian Legions such an important part of our communities.

RESOLUTION NO. 3853

I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas at the Nova Scotia Powerlifting and Bench Press Championships, Cape Breton competitors won 11 provincial titles beginning with first-time competitor Todd Samson who won the gold in the Open Category for a total lift of 1,554 pounds; and

Whereas in the Masters Division, Roddie MacNeil of Sydney won gold in his class with Peter Siepierski claiming two provincial titles in the Junior Division; and

Whereas in lifting competitions, four Cape Bretoners claimed titles, with Adam MacKinnon, Blaine Jeremais and Mitchell Curran, all of Sydney, taking gold in their class and Danny Canning of Middle River taking gold in his;

Therefore be it resolved that all members of this House applaud the incredible showing from Cape Breton competitors at the Nova Scotia Powerlifting and Bench Press Championships and extend congratulations to High School Division medal winners Ryan Ryba, Justin Laite and Noel Doucette as well as the gold medal winners.

RESOLUTION NO. 3854

I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas through a partnership between the Am Braighe newspaper and the Nova Scotia Highland Village, the Gaelic language and culture will be better promoted on the World Web; and

Whereas through a grant under the Department of Tourism's Cultural Industries Program, the project draws on the expertise of the Highland Village to expand Am Braighe's Gaelic content and make that content available for public access; and

Whereas by raising interest in the Gaelic culture and filling an existing gap in available information on the World Web, this project will help the partners heighten interest in Cape Breton and expand their common tourism markets;

Therefore be it resolved that all members of this House wish the Nova Scotia Highland Village and the Am Braighe newspaper success on their new project which will help open up the Gaelic culture and language to the rest of the world.

RESOLUTION NO. 3855

I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Maritime Centre of Excellence for Women's Health recently held its annual leadership awards presentation; and

Whereas 10 of the awards presented went to Nova Scotian residents or organizations which had made a significant contribution to women's health issues in Atlantic Canada; and

Whereas Ms. Emmie Luther-Hiltz, who helped organize the Breast Cancer Action Nova Scotia Program and coordinator of the Cancer Patient Family Network in Nova Scotia, was one of our citizens who had the honour of receiving an award;

Therefore be it resolved that this House congratulate Ms. Luther-Hiltz and the other nine award recipients for their hard work and dedication toward women's health issues.

HOUSE ORDER NO. 1

I hereby give notice that on a future day I shall move that an order of this House do issue for a return showing, with respect to the Department of Community Services:

(1) The number of applications for RRAP grants (emergency home grants) for the fiscal years 1999-2000, 2000-01, 2001-02 in each departmental housing region of the province;

(2) The number of applications approved and received funding for each of above-noted fiscal years in each of these regions; and

(3)The amount of dollars committed to and expended in each of these departmental regions for each of the above-noted years.

(1) The detailed cost analysis of the government's decision to raise the costs of FOIPOP applications from $5 to $25 or to any other fee structure presently contemplated by government;

(2) The detailed benefit analysis of the government's decision to raise the cost of FOIPOP applications from $5 to $25 or to any other fee structure presently contemplated by government;

(3) The list of names, organizations, businesses, government departments and agencies or any other party or parties to which the government consulted before implementing its new fee structure effective April 1, 2002; and

(4) The details of input and feedback provided by those listed in Item No. 3.
