HALIFAX, FRIDAY, NOVEMBER 17, 2000

Fifty-eighth General Assembly

First Session

9:00 A.M.

SPEAKER

Hon. Murray Scott

DEPUTY SPEAKERS

Mr. Brooke Taylor, Mr. Kevin Deveaux, Mr. David Wilson

MR. SPEAKER: Order, please. We will begin the daily routine.

PRESENTING AND READING PETITIONS

MR. SPEAKER: The honourable member for Cole Harbour-Eastern Passage.

MR. KEVIN DEVEAUX: Mr. Speaker, on behalf of the residents of Eastern Passage, I beg leave to file a petition. The operative clause reads, "According to the 'Evaluation of High Schools' report produced by the Department of Education in May, 2000, Cole Harbour District (High School) is the only school whose projected enrollment exceeds the 'theoretical building maximum'. Given the fact that over 50% of that school's population comes from Eastern Passage and the inability, for logistical reasons, to transfer these students to another school with less capacity pressures, it is our opinion that the only alternative is to build a high school in our community." I have affixed my signature.

MR. SPEAKER: The petition is tabled.

The honourable member for Dartmouth-Cole Harbour.

8935

[Page 8936]

MR. DARRELL DEXTER: Mr. Speaker, I beg leave to table a petition on behalf of the residents of Truro and the surrounding area. The operative clause reads, "We the undersigned are opposed to the planned cuts to the pediatric nursing staff at Colchester Regional Hospital scheduled to begin on November 2, 2000. We believe that a 50% reduction in nursing staff will put our children at risk of being treated in an unsafe health care environment. We demand that the administration of the Colchester Regional Hospital find alternative funding solutions." This has 1,003 signatures. I have affixed my signature, bringing the total to 6,008 signatures so far.

MR. SPEAKER: The petition is tabled.

PRESENTING REPORTS OF COMMITTEES

TABLING REPORTS, REGULATIONS AND OTHER PAPERS

STATEMENTS BY MINISTERS

GOVERNMENT NOTICES OF MOTION

MR. SPEAKER: The honourable Minister of Tourism and Culture.

RESOLUTION NO. 3347

HON. RODNEY MACDONALD: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas a new exhibit focusing on the condition of human rights throughout the world opened at the Museum of Natural History in Halifax on November 12th; and

Whereas the exhibit titled By What Right? traces the struggles of men, women and even children for the fundamental human rights of life, freedom, dignity, equality and solidarity; and

Whereas By What Right? reminds us all of how lucky we are to live in Canada and how we must strive for basic human rights world-wide;

Therefore be it resolved that members of this House join me in recognizing the significance of this exhibit and its timely nature as we prepare to mark International Human Rights Day on December 10th.

Mr. Speaker, I request waiver of notice.

[Page 8937]

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried.

The honourable Minister of Education.

RESOLUTION NO. 3348

HON. JANE PURVES: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas on October 22nd Dr. Colin Dodds officially became the 33rd President of Saint Mary's University; and

Whereas Dr. Dodds has devoted the past 18 years to Saint Mary's and has several academic roles at the university; and

Whereas Dr. Dodds has been a driving force behind the expansion of many international projects at Saint Mary's;

Therefore be it resolved that the members of this Legislature congratulate Dr. Dodds on being made President of Saint Mary's University and wish him every success in his new leadership role.

Mr. Speaker, I request waiver of notice.

The honourable Minister of Tourism and Culture.

[Page 8938]

RESOLUTION NO. 3349

HON. RODNEY MACDONALD: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Glenora Distillery in Glenville, Inverness County, officially launched its Glen Breton Whiskey last Sunday, November 12th; and

Whereas Jonathan D. Auerbach, award-winning travel/cuisine journalist, speaker and contributing writer at Robb Report magazine commented, "This spirited malt crafted from a small distillery in the Highlands of Cape Breton, Nova Scotia -- 'New Scotland' -- earns instant classic status. The pure waters of the distillery's MacLellan's Brook result in an exceptionally clean, light malt. Yet lightness in no way means lack of character or complexity. Single malt fanciers will prize the all-around balance of this rich yet smooth and subtle dram."; and

Whereas you can now purchase this fine Nova Scotian product in the Nova Scotia Liquor Commission and at all other liquor retail outlets throughout Canada;

Therefore be it resolved that the members of this House congratulate management and staff of the Glenora Distillery on their successful launch of Glen Breton and may all of you endeavour to sample this fine single-malt whiskey.

Mr. Speaker, I request waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

It is agreed.

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried.

The honourable Minister of Education.

RESOLUTION NO. 3350

HON. JANE PURVES: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

[Page 8939]

Whereas the YWCA of Halifax has been a vibrant component of the service network for women and their families for many years; and

Whereas the YWCA has, with remarkable energy and vitality, undertaken to move forward with a vision of being "A Wellness Centre for Women and their Families"; and

Whereas this government, through its Sport and Recreation Commission, contributed $45,000 to the restoration of this important facility for women and families;

Therefore be it resolved that all members extend the warmest congratulations of this House to the YWCA's board and staff on today's official launch of its refurbished building, its renovated multi-purpose centre and its newly reopened swimming pool, which adds to the community capacity to foster wellness in the full sense of the word.

Mr. Speaker, I request waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

It is agreed.

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried. (Interruptions)

INTRODUCTION OF BILLS

NOTICES OF MOTION

MR. SPEAKER: The honourable Leader in the House of the New Democratic Party, one at a time (Interruptions) Order, please, also known as the honourable member for Cape Breton Centre.

RESOLUTION NO. 3351

MR. FRANK CORBETT: Mr. Speaker, you would know my many aliases as you are a former policeman.

[Page 8940]

Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas more than 450,000 Canadians have signed an Internet petition designed by Rick Mercer of This Hour Has 22 Minutes to change Stockwell Day's name to Doris; and

Whereas this petition is based on the Alliance idea that only 3 per cent of the public could force a referendum on any issue if they have enough signatures; and

Whereas the member for Colchester-Musquodoboit Valley has been known to support the Alliance and backing their wacky ideas;

Therefore be it resolved that this House begin a petition to change the name of the member for Colchester-Musquodoboit Valley from Brooke to Elizabeth. (Laughter)

Mr. Speaker, I request waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

I hear a No.

The notice is tabled.

The honourable Leader of the Liberal Party.

RESOLUTION NO. 3352

MR. WAYNE GAUDET: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Villa St. Joseph du-lac in Yarmouth was established in 1960 by Les Soeurs Hospitalieres de St. Joseph; and

Whereas the villa was established to provide care for the elderly and disabled; and

Whereas on Sunday, November 19th, the villa will be celebrating its 40th Anniversary with a Eucharistic celebration and open house;

Therefore be it resolved that members of this House extend congratulations and best wishes to Les Soeurs Hospitalieres de St. Joseph, the board of directors and residents of Villa St. Joseph on this occasion of the villa's 40th Anniversary.

[Page 8941]

Mr. Speaker, I request waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

It is agreed.

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried.

The honourable member for Pictou East.

RESOLUTION NO. 3353

MR. JAMES DEWOLFE: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas Administrator Charlene Thomas and staff at the Riverview Home in Pictou County have been internationally recognized for developing a special kind of therapy; and

Whereas Ms. Thomas, after submitting this unique model of therapy to an international committee for consideration, has been chosen to make a presentation in March, in Vancouver, at the 50th Anniversary Conference of the International Association for Educational Guidance; and

Whereas the therapy is described as a non-aversive change model, which assists those with mental challenges or mental illness in learning the skills they need to become more independent;

Therefore be it resolved that MLAs commend this fantastic work being done by Charlene Thomas and her staff at the Riverview Home Adult Residential Centre in Pictou County, and wish her all the best when she speaks at the international conference in March.

Mr. Speaker, I request waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

It is agreed.

[Page 8942]

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried.

The honourable Leader in the House of the New Democratic Party.

RESOLUTION NO. 3354

MR. JOHN MACDONELL: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas when Senator Bernie Boudreau was Finance Minister and Health Minister, he described the loss of 1,250 hospital beds and the freeze on long-term beds as "right-sizing"; and

Whereas the Senator took another step towards "right-sizing" when he fended off a Canada Health Act inquiry into the Liberals' introduction of user fees for such preventive care as Pap smears; and

Whereas Senator Boudreau's "right-sizing" included the elimination of almost 1,000 nursing jobs, the biggest nursing cut in Canada;

Therefore be it resolved that Kevin Little was right when he wrote "it is the total lack of sincerity of this Party when it comes to policy in general, and poverty in particular, that leads me to conclude there is no hope for the Liberals."

Mr. Speaker, I request waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

I hear several Noes.

The notice is tabled.

The honourable member for Cape Breton South.

RESOLUTION NO. 3355

MR. MANNING MACDONALD: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

[Page 8943]

Whereas both the NDP and the Tories have used the provincial Legislature on a daily basis to promote their lost federal election causes; and

[9:15 a.m.]

Whereas clearly the Tories and the NDP are trying to draw attention away from the fact that they are failing to represent the concerns of their constituents here in the provincial Legislature; and

Whereas valuable provincial resources are being used by the NDP and the Tories for blatant partisan purposes at the federal level;

Therefore be it resolved that if the NDP and the Tories continue to waste the valuable time of this House, they should at least have the decency to ensure their donation of provincial resources is claimed as an election contribution so the taxpayers of Nova Scotia may finally receive a tax break.

Mr. Speaker, I would ask for waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

I hear several Noes.

The notice is tabled.

The honourable Minister of Health.

RESOLUTION NO. 3356

HON. JAMES MUIR: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas computers are now as important to the function of public libraries as books; and

Whereas the Bill and Melinda Gates Foundation donated $855,000 worth of computer equipment to public libraries in Nova Scotia to provide low-income earners access to computer resources, as well as the Internet; and

Whereas this grant has allowed the provincial library to establish regional computer centres in Yarmouth, Halifax, Sydney and Truro;

[Page 8944]

Therefore be it resolved that all members of this House express their gratitude to Bill and Melinda Gates for their generosity, and wish them all the best in the future.

Mr. Speaker, I would ask for waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

It is agreed.

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried.

The honourable member for Sackville-Cobequid.

RESOLUTION NO. 3357

MR. JOHN HOLM: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas this government's latest response to the federal government on seeking funding for Highway No. 101 is "please include us in the same program as Quebec"; and

Whereas that appears to be a pretty feeble attempt to secure funding for a highway that is considered the most dangerous in this province; and

Whereas taxpayers in this province pay $125 million in fuel taxes to Ottawa and will get back a mere $20 million over four years;

Therefore be it resolved that the Premier and his Minister of Transportation become a little more forceful in requests to Ottawa and demand instead of begging money to rebuild Highway No. 101.

MR. SPEAKER: The notice is tabled.

The honourable member for Lunenburg West.

RESOLUTION NO. 3358

MR. DONALD DOWNE: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

[Page 8945]

Whereas the Finance Minister is finally going to recalculate the 1993 Buchanan/LeBlanc deficit using Generally Accepted Accounting Principles after promising to have his figures ready over a year ago; and

Whereas unfortunately a whole year has passed and Nova Scotians have been left with the impression that a valid comparison between the 1993 deficit and the 1999 deficit is real; and

Whereas it is understandable that the task of recalculating the 1993 deficit would take time considering the archaic accounting methods of the Buchanan/LeBlanc era;

Therefore be it resolved that last year's failure of the minister to recalculate the 1993 deficit using GAAP can only be seen as an attempt to misrepresent the truth about the evolving financial situation in Nova Scotia, and that the minister should take immediate steps to correct the false impressions now.

MR. SPEAKER: The notice is tabled.

The honourable Minister of Tourism and Culture.

RESOLUTION NO. 3359

HON. RODNEY MACDONALD: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas Dr. Bernie MacLean of Inverness graduated from Dalhousie University in 1961, and came to Inverness Consolidated Memorial Hospital in 1962 with plans to stay for a period of six months; and

Whereas thankfully, Dr. Bernie went on to serve the community of Inverness County and surrounding area for 39 years, going beyond the call of duty, selflessly helping those with medical needs; and

Whereas this well-respected Nova Scotian physician will be honoured at a testimonial dinner in Port Hood on Saturday, November 18, 2000;

Therefore be it resolved that the members of this House acknowledge Dr. Bernie's contributions to the health of his community and wish him and his wife, Jean, continued health and prosperity.

Mr. Speaker, I would ask for waiver of notice.

[Page 8946]

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

It is agreed.

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried.

The honourable member for Halifax Needham.

RESOLUTION NO. 3360

MS. MAUREEN MACDONALD: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas Education Partners in Nova Scotia have planned a national conference from November 16th to November 18th, titled Children, Poverty and Education: Meeting the Challenge, during this very significant month for children; and

Whereas this national conference will increase awareness at all levels in the education system with regard to the difficulties faced by children living in poverty; and

Whereas this conference will offer practical and effective strategies for addressing issues related to poverty and education;

Therefore be it resolved that we congratulate the education partners on their initiative to stage this national conference and that we extend wishes for a successful event.

Mr. Speaker, I seek waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

It is agreed.

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried.

The honourable member for Dartmouth East.

[Page 8947]

RESOLUTION NO. 3361

DR. JAMES SMITH: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Minister of Health broke his promise to staff of the Colchester Regional Hospital by allowing the complement of experienced paediatric nurses to fall below the agreed to level; and

Whereas the minister seems to think everything is fine despite the fact there have been four shifts with only one nurse on the unit and seven shifts with just a float nurse and a paediatric nurse; and

Whereas the minister's negligence has even prompted one doctor to level the very serious charge that the minister "misled the House" of Assembly on the issue;

Therefore be it resolved that the Minister of Health apologize to the dedicated care providers at the Colchester Regional Hospital for dismissing their concerns and breaking his side of a bargain that was made in good faith.

Mr. Speaker, I would ask for waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

I hear several Noes.

The notice is tabled.

The honourable member for Kings West.

RESOLUTION NO. 3362

MR. JON CAREY: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas after operating for 51 years as K.C. Marshall Clothing Ltd., brothers John and Blair Marshall are closing the family-owned business to retire in mid-December; and

Whereas the parents of these brothers, Ken and Evelyn, first opened the family clothing outlet in 1949, with the sons having taken over the operation of the store in the early 1970's; and

[Page 8948]

Whereas customers always spoke of the special friendly service they received whenever shopping at Marshall's;

Therefore be it resolved that the MLAs extend our sincerest and best wishes to Blair and John Marshall and the Marshall family for providing western Kings County with a first-class shopping experience for the past 51 years.

Mr. Speaker, I request waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

It is agreed.

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried.

The honourable member for Cole Harbour-Eastern Passage.

RESOLUTION NO. 3363

MR. KEVIN DEVEAUX: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas our local schools would not be able to function without dedicated volunteers who give their time and effort for our children; and

Whereas the Tallahassee Community School in Eastern Passage is indebted to the long service of Marguerita Johnson, Library Volunteer Co-ordinator for the school, as she has maintained the library for the children of the community; and

Whereas Ms. Johnson has ensured the children at Tallahassee have access to computers, books and other materials and also does morning and lunch duties and book fairs;

Therefore be it resolved that this House congratulate Marguerita Johnson for her service to the students of Tallahassee Community School and the people of Eastern Passage and extend our thanks for her contribution to education.

I ask for waiver of notice, Mr. Speaker.

[Page 8949]

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

It is agreed.

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried.

The honourable member for Victoria.

RESOLUTION NO. 3364

MR. KENNETH MACASKILL: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas some communities north of Smokey suffered extensive flood damage in the heavy rains that hit many parts of Cape Breton recently; and

Whereas when the provincial flood relief program was announced it only covered damages that happened after November 1st; and

Whereas the damage in Neil's Harbour is a result of flooding over several days starting on October 29th;

Therefore be it resolved that the Minister responsible for the Emergency Measures Act make sure that the people of these communities have fair and equal access to this program for flood damage that began on October 29th.

Mr. Speaker, I ask for waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

I hear a No.

The notice is tabled.

The honourable Minister of Justice.

[Page 8950]

RESOLUTION NO. 3365

HON. MICHAEL BAKER: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas Mahone Bay, Lunenburg County, resident, Charles Uhlman has been a member of the Lions Club for 31 years; and

Whereas Dr. Uhlman has been elected the Vice-President of the Board of the Lions Foundation of Canada; and

Whereas Dr. Uhlman has also accepted the role of Publicity Chairman for the Canada-United States Leadership Forum, which will be hosted in Halifax next September;

Therefore be it resolved that the House of Assembly congratulate Charles Uhlman for his contribution to the Lions Club over the years and also on his election as Vice-President of the Lions Foundation of Canada.

Mr. Speaker, I seek waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

It is agreed.

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried.

The honourable member for Dartmouth-Cole Harbour.

RESOLUTION NO. 3366

MR. DARRELL DEXTER: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas Truro doctors say the Colchester Regional Hospital has been unable to live up to a commitment to adequately staff the paediatric unit; and

Whereas Obstetrician Dr. Nicholas Clague says the hospital and the Northern Regional Health Board have broken their promise to have two paediatric nurses in the unit for all shifts until an external review is completed; and

[Page 8951]

Whereas 6,008 citizens of the Colchester area have signed a petition demanding adequate staffing be maintained in the paediatric unit of the Colchester Regional Hospital;

Therefore be it resolved that the Minister of Health explain to this House and the people of Colchester why he has allowed this hospital and health board to break his word to the people of the area.

Mr. Speaker, I request waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

I hear several Noes.

The notice is tabled.

RESOLUTION NO. 3367

MR. PAUL MACEWAN: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas there is nothing so old-line as the NDP line; and

Whereas the latest poll findings reveal the NDP nationally mired at 9 per cent, in fifth place, and lucky if they will be able to elect six MPs Canada-wide on November 27th; and

Whereas the NDP has not elected a federal member in Ontario since the debacle of the Bob Rae provincial government and stands on the brink of wipe-out in Saskatchewan and B.C.;

Therefore be it resolved that Nova Scotians voters should get with it, ignore the NDP and give full support to the Liberal Party of Prime Minister Jean Chretien which provides the leadership needed to keep our country united, strong and free.

MR. SPEAKER: The notice is tabled.

The honourable member for Halifax Atlantic.

[Page 8952]

RESOLUTION NO. 3368

MR. ROBERT CHISHOLM: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas Senator Bernie Boudreau and his Liberal candidates are telling Nova Scotians that the federal government loves this province again and is sorry that it hurt Nova Scotia so much; and

Whereas Nova Scotians can tell just how much they are loved when they learn that before the election $350 million was committed to Highway No. 30 in Montreal but nothing was committed to Highway No. 101 in Nova Scotia; and

Whereas Nova Scotians remember how much the Liberals have done for health care every time they visit an overcrowded emergency room;

Therefore be it resolved that no matter how many election-eve goodies the Liberals promise, Nova Scotians would do well to remember the words of Kevin Little that appeared in The Chronicle-Herald on May 23, 1997 when he said (Interruptions)

MR. SPEAKER: Order, please. The honourable member for Halifax Atlantic has the floor. (Interruptions) Order, please.

MR. ROBERT CHISHOLM: Mr. Speaker, I will start the therefore be it resolved over.

Therefore be it resolved that no matter how many election-eve goodies the Liberals promise, Nova Scotians would do well to remember the words of Kevin Little that appeared in The Chronicle-Herald on May 23, 1997, "it was all a sham, a ruse. It was a total lie."

Mr. Speaker, I seek waiver of notice.

MR. SPEAKER: The notice of motion was way too long. (Interruptions) Order, please. (Interruptions) Even without that.

[The notice is tabled.]

MR. SPEAKER: The honourable member for Cape Breton West.

RESOLUTION NO. 3369

MR. RUSSELL MACKINNON: Mr. Speaker, we may as well keep going. (Interruptions)

[Page 8953]

Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas during the election the Tories said Highway No. 101 was their number one priority and would begin twinning with or without federal money; and

Whereas last year the two Tory backbenchers, better known as the Dukes of Hazzard, went to Ottawa with a letter of approval from the Transportation Minister looking for money for a highway on the Eastern Shore; and

Whereas this summer the Tories said their new priority was the infamous road to nowhere, which John Buchanan built for Elmer MacKay;

Therefore be it resolved that no wonder Ottawa is confused about Nova Scotia's highway priorities because this Tory Government can never get its story straight.

MR. SPEAKER: The notice is tabled.

The honourable member for Halifax Chebucto.

RESOLUTION NO. 3370

MR. HOWARD EPSTEIN: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas HRM Council has taken a progressive step in adopting a by-law to control the use of pesticides in residential neighbourhoods; and

[9:30 a.m.]

Whereas HRM Council was able to do so because of provisions in the Municipal Government Act that give it specific regulatory powers; and

Whereas other municipalities in Nova Scotia do not have equivalent regulatory powers respecting pesticides;

Therefore be it resolved that the government consider making amendments to the Municipal Government Act to extend that greater range of powers to all municipalities in the province.

MR. SPEAKER: The notice is tabled.

The honourable member for Cape Breton The Lakes.

[Page 8954]

RESOLUTION NO. 3371

MR. BRIAN BOUDREAU: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas on Friday, November 10, 2000, Beth McCharles of Coxheath was named CIAU All-Canadian; and

Whereas Beth McCharles is a goalkeeper for the St. F.X. University Women's soccer team; and

Whereas in 1998 Ms. McCharles was selected as a CIAU Second Team All-Canadian and was recently named as Atlantic University Sport first-team all star;

Therefore be it resolved that members of this House congratulate Beth McCharles of Coxheath and recognize her outstanding contribution to the sport of soccer here in Nova Scotia.

Mr. Speaker, I would ask for waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

It is agreed.

Would all those in favour of the motion please say Aye. Contrary minded, Nay.

The motion is carried.

The honourable member for Dartmouth North.

RESOLUTION NO. 3372

MR. JERRY PYE: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas on December 18, 1996, future Senator Bernie Boudreau told this House that "real, substantial, important issues" were involved in the failure of the Canada Health Act to cover Pharmacare and home care; and

Whereas the Senator is part of a federal government that spent $100 billion on tax breaks, but nothing to cover Pharmacare and home care; and

[Page 8955]

Whereas Senator Bernie Boudreau now has no one but himself and his Liberal pals to blame; (Interruption)

MR. SPEAKER: Order, please, the honourable member for Dartmouth North has the floor.

MR. PYE: Thank you, Mr. Speaker.

Therefore be it resolved that the Liberal candidates should explain why working families should trust a team led by a Senator who closed 1,250 hospital beds, then ignored the growth of a two-tiered health care in his rush to hand out federal tax cuts for big corporations and the rich.

Mr. Speaker, I would ask for waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

I hear a No.

The notice is tabled.

The honourable member for Cape Breton East.

RESOLUTION NO. 3373

MR. DAVID WILSON: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas small business is the backbone of the Nova Scotia economy; and

Whereas before the Red Tape Reduction Task Force reported the committee member for Kings West stated, "Businesses, specially those of a small or medium size will feel the benefits of our work in the days ahead"; and

Whereas the recommendation that municipalities be allowed to set Sunday shopping hours means that small businesses will indeed feel something as a result of the Red Tape Reduction Task Force;

Therefore be it resolved that the members of this House recognize that the Red Tape Reduction Task Force Sunday shopping recommendation will hurt Nova Scotia small business instead of helping them, especially in the riding of Kings West.

Whereas active participation in sports can improve one's appreciation of the good things in life in more ways than one; and

Whereas lower profile sports such as lawn bowling are nonetheless important activities for many people; and

Whereas Lena Cameron of Enfield won the honour of representing Nova Scotia at the Canadian Lawn Bowling Championship in Edmonton next summer by means of her winning form at the provincial championship held in Halifax this summer past;

Therefore be it resolved that this House of Assembly congratulate Lena Cameron on her skills and her good example of staying active, and wish her good luck next year.

RESOLUTION NO. 3375

MR. MANNING MACDONALD: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the minister responsible for NSRL refuses to tell Nova Scotians whether or not they are selling an asset or a liability; and

Whereas the province is selling its 8.4 per cent of the Sable gas project that could mean Nova Scotians are denied access to their own natural gas; and

Whereas the bulk of the NSRL debt was rung up under the Donnie Cameron Government, a government that the Finance Minister was part of;

Therefore be it resolved that the Minister of Finance be condemned for his convenient memory loss that makes him unable to remember the Tory Governments he was part of, including the government that racked up over $600 million of NSRL debt with no benefit to Nova Scotia.

Mr. Speaker, I would ask for waiver of notice.

MR. SPEAKER: There has been a request for waiver.

MR. JOHN HOLM: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas every day in the Province of Nova Scotia six more children are born into poverty; and

Whereas since August 17, 1999, this Tory Government's first full day in office, 2,748 children have been born into poverty; and

[Page 8958]

Whereas this heartless Tory Government would prefer to talk about only one kind of deficit, a budget deficit;

Therefore be it resolved that this Tory Government start waking up to the health, education and social deficits faced by the 2,748 children born into poverty under this Tory Regime.

Mr. Speaker, I request waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Whereas Patti Barkhouse Young will showcase images of Lunenburg and Queens Counties in a selection of her pen-and-ink drawings; and

Whereas in 1997, some of Mrs. Barkhouse Young's older landscape drawings were made into cards;

Therefore be it resolved that the members of this House recognize Patti Barkhouse Young's outstanding accomplishments and wish her continued success in all her future endeavours.

Whereas Portland Estates Elementary School has promoted democratic rights and citizen participation through a mock election at the school; and

Whereas Grade 6 students have chosen to work on campaigns representing all federal Parties; and

Whereas the feast of San Martino symbolizes the end of the farming season in Italy; and

Whereas the feast of San Martino, which traditionally occurs on November 11th is being celebrated in Halifax on Saturday, November 18th;

Therefore be it resolved that the members of this House extend to the Halifax-Dartmouth Italian community their best wishes for an enjoyable San Martino celebration.

RESOLUTION NO. 3380

MR. FRANK CORBETT: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas in 1988, the province ended the practice of forcing the surrender of family homes after the owner had received social assistance or nursing home care; and

Whereas yesterday the Department of Community Services issued a news release saying that recipients will not be forced to sell their family home before they apply for social assistance; and

Whereas it would be equally reassuring to promise that one will not lose one's head before it is placed in the guillotine;

[Page 8961]

Therefore be it resolved that the Minister of Community Services should either keep the law protecting family homes from forced surrender or else have the courage to tell the whole truth about what he is doing and why.

RESOLUTION NO. 3381

DR. JAMES SMITH: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the players, coaches and management of the Huskies deserve top marks for their drive and determination to reach the top prize in university football - the Vanier Cup;

Therefore be it resolved that the members of this House extend good luck and best wishes to the Saint Mary's Huskies as they get set to top off another championship season with, undoubtedly, another Atlantic Bowl victory.

Mr. Speaker, I request waiver of notice.

RESOLUTION NO. 3382

MR. DARRELL DEXTER: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas over the past number of days I have presented to this House petitions for the people serviced by the Colchester Regional Hospital totalling 6,008 signatures; and

Whereas people in the area serviced by the Colchester Regional Hospital feel their own MLA is not representing their concerns here in this Legislature and with the provincial government; and

Whereas the Minister of Health, the MLA for Truro-Bible Hill, refuses to listen to the very people who elected him;

Therefore be it resolved that the Minister of Health reconsider his ill-conceived and ill-planned cuts at the Colchester Regional Hospital and restore full paediatric care nursing to the hospital as demanded by the residents.

MR. SPEAKER: The notice is tabled.

The honourable member for Victoria.

RESOLUTION NO. 3383

MR. KENNETH MACASKILL: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Highland Village in Iona is one of the finest community museums in Nova Scotia, if not Canada; and

Whereas for the first time in several years, tourism numbers at the Highland Village are down despite the existence of a full-time Tourism Minister; and

Whereas the minister pointed to new jobs at the Highland Village as proof this government is working to promote tourism, even though the funding for these jobs came from Ottawa;

Therefore be it resolved that the federal Liberal Government of Jean Chretien deserves to be thanked for funding new jobs at the Highland Village because this Tory Government is doing nothing to help tourism in Cape Breton.

[Page 8963]

MR. SPEAKER: The notice is tabled.

The honourable member for Halifax Atlantic.

RESOLUTION NO. 3384

MR. ROBERT CHISHOLM: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Premier and his colleagues have moved into full-throttle damage control to try to explain why they are repealing the protection of family homes of social assistance recipients; and

Whereas the one step that would best reassure Nova Scotians is the announcement that the law protecting homes from forced surrender will remain on the books; and

Whereas so far the government has not agreed to any such amendment, choosing instead to issue news releases and false assurances;

Therefore be it resolved that this House urges the Premier to follow his Tory predecessors and leave in place the 1988 law by which this House made sure that no regulation or arbitrary action could result in the forced surrender of a family home to pay for social assistance.

Mr. Speaker, I request waiver of notice.

MR. SPEAKER: There has been a request for waiver.

Is it agreed?

I hear several Noes.

The notice is tabled.

The honourable member for Cape Breton East.

RESOLUTION NO. 3385

MR. DAVID WILSON: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the member for Bedford-Fall River is taking offence to the former Town of Bedford being referred to as Bedrock; and

[Page 8964]

Whereas the fictional Town of Bedrock has provided 40 years of entertainment for children and adults alike, where the good citizens of Bedrock lead productive lives, keep nice homes and share a strong sense of community; and

Whereas any comparison to Bedrock should be seen as a compliment rather than a slur, especially to the current Community Services Minister because as far as we know, everybody had a job in Bedrock;

Therefore be it resolved that the members of this House urge the Minister of Community Services to lighten up a little and realize that while Bedrock is not perfect, it could be a model for Tory social assistance reform considering both ideas share the same Stone Age origin.

MR. SPEAKER: The notice is tabled.

The honourable member for Halifax Chebucto.

RESOLUTION NO. 3386

MR. HOWARD EPSTEIN: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas HRM Council has taken a progressive step in adopting a by-law to control the use of pesticides in residential neighbourhoods; and

Whereas the federal government process for the registration of pesticides involves estimates of the impact on human health based on extrapolations from lab-animal testing measured on what will happen when an adult, healthy male is exposed to a limited dosage; and

Whereas a one-size-fits-all approval leaves out of account cumulative exposures to multiple chemicals and the sensitivities of children;

Therefore be it resolved that the Acting Minister of Environment and Labour take action to press the federal government to change its process for the registration of pesticides to take account of the special vulnerability of children.

MR. SPEAKER: The notice is tabled.

Whereas members of the NDP have abused the trust of Nova Scotians by fighting the federal election on the floor of this House; and

[9:45 a.m.]

Whereas the NDP focus on the federal election is because they are scared of losing just about every MP they have in Nova Scotia;

Therefore be it resolved that the NDP should pay attention to provincial issues, such as getting a seat in this House for their Leader instead of just a seat in the library.

Mr. Speaker, I would ask for waiver of notice.

MR. JERRY PYE: Mr. Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Nova Scotia Poverty Report Card indicates that in 1989 Nova Scotia's poverty rate was the fourth lowest in Canada, as of 1998 Nova Scotia was the second highest; and

[Page 8966]

Whereas the report also states, "Concerned observers should look at the poor performance of governments in protecting Nova Scotia's families from poverty and are prompted to ask: 'Why are the needs of our nation's children being neglected and why are Nova Scotia's children worse off than their counterparts in other provinces?'"

Therefore be it resolved that the Premier rise in this House today and answer the question, ". . . why are Nova Scotia's children worse off than their counterparts in other provinces?"

Whereas the Nova Scotia Student Advocacy Coalition recommends that the government replace the cancelled Loan Remission Program with a Nova Scotia student grant program;

Therefore be it resolved that this government heed the request of the Nova Scotia Student Advocacy Coalition and consider taking steps to initiate a Nova Scotia student grant program.

Whereas the Maritime Centre of Excellence for Women's Health has recently published a trilogy featuring a selection of 22 research profiles from studies it has sponsored; and

Whereas this trilogy aptly reflects the centre's mandate and the role it plays in this region by filling a void in health research pertaining to women; and

Whereas the centre's "Call to Action" asks governments, federal and provincial, for their support of policy-based health research here in Atlantic Canada;

Therefore be it resolved that this House congratulate the Maritime Centre of Excellence for Women's Health staff, research associates and partners for their important contribution to the health and well-being of women in Atlantic Canada.

Whereas the constituents of the MLA for Kings South are demanding a public apology from their MLA; and

[Page 8968]

Whereas in an e-mail - which I will table - sent to the MLA for Kings South, he is accused of telling Mrs. Joyce Griffin to shut up and then slamming the receiver down on her; and

Whereas this type of behaviour cannot be tolerated by Tory MLAs who face tough questions by their constituents;

Therefore be it resolved that the Premier direct the member for Kings South to make a public apology to Mrs. Joyce Griffin for this unwarranted treatment, and I suggest an anger management course for this member as well.

Mr. Speaker, I request waiver of notice.

Whereas the current PC Government's tourism numbers are 13 per cent ahead of where the previous Liberal Government was in 1998; and

Whereas one of the reasons is our newest Nova Scotia museum, the Highland Village in Iona; and

Whereas the Savage/MacLellan Liberals didn't have the intestinal fortitude to make them part of the Nova Scotia Museum even after many continued promises;

Therefore be it resolved that the members of this House remind the Liberals of this promise which they made but did not keep, and encourage the MLA for Victoria to congratulate this government publicly for doing what his government could not do.
