An Act to Require the Government of Nova Scotia
to Purchase Food Products from Maritime Producers

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Buy Maritime First Act.

2 In this Act, "local food" means food items grown, raised, caught, harvested, produced or manufactured in the Province, New Brunswick or Prince Edward Island and includes any food items designated in the regulations as local food.

3 This Act binds His Majesty in right of the Province.

4 Subject to Section 8, where any

(a) department or office of the public service within the meaning of the Public Service Act;

(b) public school within the meaning of the Education Act;

(c) hospital within the meaning of the Hospitals Act; or

(d) correctional facility within the meaning of the Corrections Act,

buys food items to supply its operations, it shall give preference to the purchase of local food and shall purchase local food in accordance with the regulations.

5 The Premier shall advocate for the removal of interprovincial barriers to the purchase and trade of local food with the Council of Atlantic Premiers.

6 (1) The Governor in Council may make regulations

(a) designating food items as local food for the purpose of this Act;

(b) further defining "local food";

(c) respecting the purchase of local food by departments and offices;

(d) respecting the manner in which departments and offices are to give preference to the purchase of local food;

(e) defining any word or expression used but not defined in this Act;

(f) respecting any matter or thing the Governor in Council considers necessary or advisable to carry out effectively the intent and purpose of this Act.

(2) The exercise by the Governor in Council of the authority contained in subsection (1) is a regulation within the meaning of the Regulations Act.

7 The Government shall, within 90 days of the coming into force of this Act, make public draft regulations for the purpose of this Act, including regulations further defining "local food" with respect to agricultural and aquacultural production in the Province.

8 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
