Explanatory Note

This Bill creates a seniors income benefit for individuals eligible for a supplement under Part II of the Old Age Security Act (Canada).

An Act to Amend Chapter 217
of the Revised Statutes, 1989,
the Income Tax Act,
Respecting a Seniors Income Benefit

Be it enacted by the Governor and Assembly as follows:

1 Chapter 217 of the Revised Statutes, 1989, the Income Tax Act, is amended by adding immediately after Section 36B the following heading and Section:

Subdivision jc - Seniors Income Benefit

    36C (1) Subject to subsection (7), an individual is entitled to a benefit under this Section if the individual

    (a) was resident in the Province on the last day of the taxation year; and

    (b) is eligible for a supplement under Part II of the Old Age Security Act (Canada).

    (2) The amount of a benefit under this Section is as prescribed in the regulations.

    (3) A benefit under this Section must be paid in monthly instalments.

    (4) The Governor in Council may make regulations prescribing

    (a) the amount of a benefit under this Section;

    (b) anything necessary or advisable to enable His Majesty in right of Canada to administer, on behalf of His Majesty in right of the Province, the benefit.

    (5) In making regulations under subsection (4), the Governor in Council shall consider the Low-Income-Cut-Off, Low Income Measure and Market-Basket Measure as determined by Statistics Canada.

    (6) The Governor in Council shall adjust the benefit annually to reflect changes in the Consumer Price Index, as determined by Statistics Canada.

    (7) The money required for the purpose of this Section must be paid out of money appropriated for that purpose by the Legislature.
