Explanatory Note

This Bill requires holders of aquaculture licences or leases to report to the Minister of Fisheries and Aquaculture respecting their aquaculture site and for the Minister to post these reports on an online public database.

An Act to Amend Chapter 25
of the Acts of 1996,
the Fisheries and Coastal Resources Act

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Aquaculture Transparency Act.

2 Chapter 25 of the Acts of 1996, the Fisheries and Coastal Resources Act, is amended by adding immediately after Section 61 the following Section:

    62 (1) The holder of an aquaculture licence or aquaculture lease shall report to the Minister, in the manner and within the time prescribed, on the operation of the licence or lease holder's aquaculture site, including with respect to

      (a) the monitoring of fish health and fish mortality;

      (b) the use of antibiotics, pesticides or other treatments on fish;

      (c) fish escape;

      (d) oxygen conditions;

      (e) public complaints;

      (f) environmental impacts; and

      (g) any additional information prescribed.

    (2) The Minister shall consult with aquaculture stakeholders to determine any additional information that must be reported on pursuant to clause (1)(g).

    (3) The Minister shall cause the reports made under subsection (1) to be posted on an online database accessible to the public.

    (4) The Minister shall make regulations respecting the reporting requirements under subsection (1), including regulations respecting the manner and timing of reporting and information that must be included in reports.

    (5) The exercise by the Minister of the authority contained in subsection (4) is a regulation within the meaning of the Regulations Act.
