Explanatory Notes

Clause 1 adds definitions of "Alumni Association" and "St. F. X. University Students' Union" and amends the definition of "Faculty".

Clause 2 sets out the composition of the Board of Governors of the University.

Clause 3

(a) removes the power of the Board to appoint a person or committee to deal with the discipline of students; and

(b) permits the Board to make by-laws respecting the discipline of students, including the imposition of fines, suspensions and expulsions.

Clause 4

(a) requires the Board to elect officers;

(b) requires the Board to appoint a non-governor to act as Secretary of the Board;

(c) provides that the Vice-President Finance and Administration shall be the Treasurer of the Board; and

(d) provides that neither the Secretary nor the Treasurer may be governors.

Clause 5 adds the Academic Vice-President and Provost and Vice-President Finance and Administration as signing officers and removes the Secretary as a signing officer.

Clause 6 provides that this Act has effect on and after July 1, 2023.

An Act to Amend Chapter 29
of the Acts of 2014,
the St. Francis Xavier University Act

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 29 of the Acts of 2014, the St. Francis Xavier University Act, is amended by

(a) re-lettering clause (a) as clause (aa);

(b) adding immediately before clause (aa) the following clause:

    (a) "Alumni Association" means the Alumni Association of St. Francis Xavier's College incorporated under Chapter 195 of the Acts of 1908, An Act to incorporate The Alumni Association of St. Francis Xavier's College";

(c) striking out clause (e) and substituting the following clause:

    (e) "Faculty" means the individuals so designated in the by-laws;

and

(d) adding immediately after clause (j) the following clause:

    (ja) "St. F. X. University Students' Union" means the Saint Francis Xavier University Students' Union incorporated under the Companies Act;

2 Subsection 7(1) of Chapter 29 is repealed and the following subsection substituted:

    (1) The Board is composed of

    (a) the Chancellor;

    (b) the President;

    (c) the Bishop;

    (d) one person appointed by the Bishop;

    (e) the President of the Alumni Association;

    (f) one member of the alumni of the University appointed by the Alumni Association;

    (g) two members of the Faculty elected by the Faculty, each having not less than five years' service to the University;

    (h) two persons appointed by the priests of the Diocese;

    (i) the President of the St. F. X. University Students' Union;

    (j) one member of the St. F. X. University Students' Union elected by the students of the University; and

    (k) 12 governors as may be elected by the Board.

3 Section 8 of Chapter 29 is amended by

(a) striking out clause (h); and

(b) striking out clause (k) and substituting the following clause:

    (k) make by-laws respecting

      (i) any of the foregoing matters,

      (ii) the discipline of students, including the imposition of fines, suspensions and expulsions, and

      (iii) all such other matters as may appertain to or be considered expedient in the best interests of the University.

4 Section 9 of Chapter 29 is repealed and the following Section substituted:

    9 (1) Subject to subsection (2), the Board shall, in the manner specified by the by-laws, elect officers of the Board to fulfill such roles and duties as may be prescribed by the Board from time to time.

    (2) The Board shall, in the manner prescribed by the by-laws, appoint a non-governor to act as the Secretary to fulfill such roles and duties as may be prescribed by the Board from time to time.

    (3) The Vice-President Finance and Administration shall act as the Treasurer of the Board.

    (4) Neither the Secretary nor the Treasurer may be governors.

5 Section 17 of Chapter 29 is amended by striking out "Secretary and the Academic Vice-President" in the fourth and fifth lines and substituting "Academic Vice-President and Provost and the Vice-President Finance and Administration".

6 This Act has effect on and after July 1, 2023.
