An Act to Require Backup Power
at Petrol Stations

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Petrol Station Backup Power Act.

2 In this Act,

(a) "backup power" means an on-site supply of electricity in the event of a disconnection from the electrical grid, including any combination of electricity from generators powered by fuel stored on-site and batteries;

(b) "Minister" means the Minister responsible for the Office of Emergency Management;

(c) "petrol station" means a business that sells gasoline or diesel oil to the public.

3 All petrol stations constructed after the coming into force of this Section must maintain backup power sufficient to allow normal operations of the station for at least 24 hours.

4 (1) The Minister may designate any petrol station as an essential petrol station.

(2) An essential petrol station must maintain backup power sufficient to allow normal operations of the station for at least 24 hours.

(3) In making a designation under subsection (1), the Minister shall consider the geographic area served by the petrol station, the population served by the petrol station and the proximity of other petrol stations that have backup power.

5 Subject to Section 7, the Government shall provide funding for backup power required by this Act in accordance with the regulations.

6 (1) The Governor in Council may make regulations respecting a program to provide funding for backup power required by this Act.

(2) The exercise by the Governor in Council of the authority contained in subsection (1) is a regulation within the meaning of the Regulations Act.

7 The money required for the purpose of Section 5 must be paid out of money appropriated for that purpose by the Legislature.
