Explanatory Note

This Bill amends the new Limitation of Actions Act to revive expired limitation periods and remove limitation periods not yet expired in relation to certain sexual torts committed before the new Act comes into force if the defendant committed, knowingly aided or encouraged or knowingly permitted the defendant's agent or employee to commit the tort.

Passed during the Current Session
of the 62nd General Assembly

Be it enacted by the Governor and Assembly as follows:

1 Section 23 of the Limitation of Actions Act, passed during the current Session of the 62nd General Assembly, is amended by adding immediately after subsection (3) the following subsection:

(4) Notwithstanding subsection (3), where a claim in relation to trespass to the person, assault or battery is based on misconduct of a sexual nature that the defendant committed, knowingly aided or encouraged or knowingly permitted the defendant's agent or employee to commit, there is no limitation period in respect of the claim, even if the former limitation period expired before the effective date.
