An Act to Create
a Provincial Advisory Council
on the Sustainability of Health Care

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Health-care Sustainability Advisory Council Act.

2 In this Act, "Advisory Council" means the Health-care Sustainability Advisory Council.

3 The Governor in Council shall appoint nine persons to be the Advisory Council, of whom no more than four hold or have held a licence to practise a regulated health profession within or outside the Province.

4 A member of the Advisory Council holds office for such term as the Governor in Council determines.

5 Subject to Section 9, the members of the Advisory Council shall be paid such remuneration as is determined by the Governor in Council and reimbursed for actual and reasonable expenses incurred by them in the discharge of their duties.

6 The Governor in Council shall designate one of the members of the Advisory Council to be the Chair and one of the members to be the Vice-chair.

7 The Advisory Council shall

(a) solicit and evaluate proposals from any individual, group or organization that would result in the delivery of safe, effective and cost-efficient health care;

(b) make recommendations to the Minister of Health respecting the delivery of programs and services to ensure and maintain the delivery of safe, effective and cost-efficient health care; and

(c) review the administration and operations of district health authorities for the purpose of recommending changes to the governance structure for the delivery of health care.

8 (1) The Governor in Council may make regulations respecting any matter the Governor in Council considers necessary or advisable to carry out effectively the intent and purpose of this Act.

(2) The exercise by the Governor in Council of the authority set out in subsection (1) is regulations within the meaning of the Regulations Act.

9 The sums required for the purpose of this Act must be paid out of moneys appropriated for that purpose by the Legislature.
