Explanatory Notes
Clause 1 adds to the power of an inspector to direct that an amusement park, device or structure shall not be used where there is a source of danger to the health and safety of persons, that the direction may be made orally and immediately.
(a) increases the penalty for a violation of the Act or the regulations to
(ii) one hundred thousand dollars, in the case of a corporation; and
(b) adds a penalty of one thousand dollars a day for any owner that leaves an amusement park open or an amusement device or structure in use in violation of an order under this Act or the regulations.
Clause 3 add to the regulation-making power respecting financial responsibility for damage claims for injury suffered from use of amusement parks that liability insurance must not be less than one million dollars.
An Act to Amend Chapter 12
of the Revised Statutes, 1989,
the Amusement Devices Safety Act
1 Section 13 of Chapter 12 of the Revised Statutes, 1989, the Amusement Devices Safety Act, is amended by adding immediately after subsection (1) the following subsection:
2 (1) Subsection 18(1) of Chapter 12 is repealed and the following subsection substituted:
(a) in the case of a person, not more than two thousand dollars; and
(b) in the case of a corporation, not more than one hundred thousand dollars.
(2) Section 18 of Chapter 12 is further amended by adding immediately after subsection (2) the following subsection:
(a) an amusement park remains open; or
(b) an amusement device or structure remains in use, in violation of an order made under this Act or the regulations.
3 Clause 20(1)(k) of Chapter 12 is amended by adding ", in the case of liability insurance, an amount not less than one million dollars," immediately after "amount" in the first line.
