Explanatory Notes

Clause 1 provides the authority for

(a) the Halifax Regional Municipality and the Water Commission to enter into an agreement to repay the Water Commission for money borrowed to provide the extension of a water service throughout the Municipality; and(b) the Municipality to impose a charge to cover the cost of the loan referred to in (a).
Clause 2 provides that this Act comes into force on proclamation.

An Act to Amend Chapter 55
of the Acts of 1963,
the Halifax Regional Water Commission Act

1 Chapter 55 of the Acts of 1963, the Halifax Regional Water Commission Act, is amended by adding immediately after Section 19 the following Sections:

19A Where funds are borrowed under Section 19 for purposes of providing the extension of water service throughout the Regional Municipality, the Commission and the Regional Municipality may enter into an agreement for the Regional Municipality to pay to the Commission the amount, in whole or in part, of the funds borrowed.19B The Regional Municipality may impose a charge to cover the cost of payments made to the Commission under an agreement referred to in Section 19A as though it were a charge for the municipal portion of the capital cost of installing a water system under clause 81(1)(c) of the Municipal Government Act.
2 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
