Explanatory Note

This Bill changes the name of the Metro United Way to the United Way of Halifax Region.

An Act to Amend Chapter 73
of the Acts of 1972,
An Act to incorporate
The Halifax-Dartmouth United Appeal

Be it enacted by the Governor and Assembly as follows:

1 The name of the Metro United Way, a body corporate, incorporated by Chapter 73 of the Acts of 1972 and renamed by Chapter 72 of the Acts of 1975 and by Chapter 73 of the Acts of 1989, is changed to the "United Way of Halifax Region".

2 The title of Chapter 73 of the Acts of 1972 is amended by striking out "The Halifax-Dartmouth United Appeal" and substituting "the United Way of Halifax Region".

3 Chapter 73 of the Acts of 1972 is further amended by renumbering Section 1 as Section 1A and adding immediately before Section 1 the following Section:

1 This Act may be cited as the United Way of Halifax Region Act.

4 (1) Subsection 1(1) of Chapter 73 of the Acts of 1972, as amended by Chapter 73 of the Acts of 1989, is further amended by striking out "hereinafter referred to as "the United Appeal"" in the fourth line.

(2) Section 1 of Chapter 73 of the Acts of 1972, as amended by Chapter 73 of the Acts of 1989 and renumbered as Section 1A by this Act, is further amended by adding immediately after subsection (4) the following subsections:

(5) Notwithstanding subsections (1) and (2) or any other enactment, on and after July 1, 2002, the body corporate constituted by subsection (1) shall be known as the "United Way of Halifax Region".

(6) Notwithstanding subsection (3), a reference in any enactment or document to The Halifax-Dartmouth United Appeal, the United Way of Halifax-Dartmouth Metro Area or the Metro United Way shall, as regards any subsequent transaction, matter or thing, be held and construed to be a reference to the United Way of Halifax Region.

(7) No rights, duties, obligations or liabilities of the Metro United Way are in any way affected by the changes of name made by subsection (5) or Chapter 72 of the Acts of 1975 and those rights, duties, obligations and liabilities continue to be vested in and are binding upon it under the name "United Way of Halifax Region".

5 Section 2 of Chapter 73 of the Acts of 1972 is amended by

(a) striking out "United Appeal" in the first line and substituting "United Way of Halifax Region";

(b) striking out "United Appeal's" in the third line of clause (d) and substituting "United Way of Halifax Region's"; and

(c) striking out "United Appeal" in the fifth line of clause (d) and substituting "United Way of Halifax Region".

6 Sections 3 to 5, 7 and 8 of Chapter 73 of the Acts of 1972, are amended by striking out "United Appeal" wherever it appears and substituting in each case "United Way of Halifax Region".
