Explanatory Note

This Bill increases penalties for contravention of the Fisheries and Coastal Resources Act or regulations or a licence or lease under the Act, to be in line with the penalties under the federal Fisheries Act.

An Act to Amend Chapter 25
of the Acts of 1996,
the Fisheries and Coastal Resources Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 116(1) of Chapter 25 of the Acts of 1996, the Fisheries and Coastal Resources Act, is repealed and the following subsection substituted:

(1) A person who contravenes this Act or the regulations or fails to comply with a term or condition of a licence or lease issued pursuant to this Act is guilty of an offence and liable on summary conviction to a fine not exceeding one hundred thousand dollars or, in default of payment, to imprisonment for a period not exceeding one year.

(2) Subsection 116(3) of Chapter 25 is repealed and the following subsection substituted:

(3) Notwithstanding subsection (1), a person who is guilty of a second or subsequent offence, other than by virtue of subsection (2), is liable on summary conviction to a fine not exceeding five hundred thousand dollars or to imprisonment for a period not exceeding one year, or to both a fine and imprisonment.
