Explanatory Note

This Bill

(a) requires the Minister of Education and Culture to determine the most cost-effective financing option before constructing, altering or adding to buildings or other works for school purposes; and

(b) requires a separate item in the Appropriations Act for each year that there is an expenditure respecting a lease for a term of five years or more of a public school.

An Act to Amend Chapter 1
of the Acts of 1995-96,
the Education Act,
to Ensure Fiscal Responsibility
Respecting School Construction

Be it enacted by the Governor and Assembly as follows:

1 Section 88 of Chapter 1 of the Acts of 1995-96, the Education Act, is amended by adding immediately after subsection (1) the following subsections:

(1A) Notwithstanding subsection (1), the Minister shall not exercise any power pursuant to clause (1)(b) until the Minister has determined the most cost-effective financing option.

(1B) Every lease for a term of five years or more of any public school is subject to the expenditures respecting that lease being included as a separate item in the Appropriations Act for each fiscal year in which the expenditures are made.
