Clause 1 requires that Nova Scotia Power Incorporated's excess annual earnings be returned or credited to customers.

Clause 2 caps Nova Scotia Power's general rate increases at two per cent per year.

Clauses 3 and 4 remove Nova Scotia Power's ability to recover remuneration paid to executive employees from rates, charges or fees.

An Act to Amend Chapter 380
of the Revised Statutes, 1989,
the Public Utilities Act,
Respecting Earnings and Rates

Be it enacted by the Governor and Assembly as follows:

1 Section 45 of Chapter 380 of the Revised Statutes, 1989, the Public Utilities Act, is amended by adding immediately after subsection (2) the following subsection:

    (3) Annual earnings by Nova Scotia Power Incorporated in excess of its rate of return determined under subsection (1) must be returned or credited to customers in any manner that the Board determines appropriate.

2 Section 64A of Chapter 380, as enacted by Chapter 45 of the Acts of 2006 and amended by Chapter 41 of the Acts of 2012, is further amended by adding immediately after subsection (1) the following subsection:

    (1A) The utility may not be granted a general rate increase that exceeds two per cent per year.

3 Clause 64B(8)(b) of Chapter 380, as enacted by Chapter 41 of the Acts of 2012, is amended by striking out "except remuneration that is prescribed by the regulations," in the first and second lines.

4 Subsection 118(1) of Chapter 380, as enacted by Chapter 41 of the Acts of 2012 and amended by Chapter 38 of the Acts of 2019, is further amended by striking out clause (a).
