Explanatory Notes

Clause 1 provides that the transition allowance payable to a person upon ceasing to be a member of the House of Assembly is not payable to a person upon ceasing to be a member if the person is entitled to an immediate retiring allowance other than a reduced allowance. This Clause also corrects a cross-reference error.

Clause 2 provides that

(a) no inquiry and report may be undertaken respecting the annual indemnity and salaries paid pursuant to the House of Assembly Act and the Executive Council Act until after the first general election after December 31, 2017; and

(b) no increases in them shall occur in the three years preceding January 1, 2018.

Clauses 3 and 4 change obsolete references to the salaries of the Chief Clerk and Assistant Clerk to the present practice for determining those salaries.

An Act to Amend Chapter 1
(1992 Supplement)
of the Revised Statutes, 1989,
the House of Assembly Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 40(1) of Chapter 1 (1992 Supplement) of the Revised Statutes, 1989, the House of Assembly Act, as amended by Chapter 47 of the Acts of 2001 and Chapter 39 of the Acts of 2011, is further amended by

(a) adding "or" at the end of clause (a);

(b) striking out "; or" at the end of clause (b) and substituting a comma;

(c) striking out clause (ba); and

(d) striking out "(e)" in the last line and substituting "(d)".

(2) Section 40 of Chapter 1, as amended by the recommendations of the Nova Scotia Commission of Inquiry on Remuneration of Elected Provincial Officials for 1994, 1999 and 2000, Chapter 47 of the Acts of 2001 and Chapter 39 of the Acts of 2011, is further amended by adding immediately after subsection (1A) the following subsection:

(1B) Notwithstanding subsections (1) and (1A), no transition allowance is payable to a person, or the estate of a person, who is or would have been entitled to receive an immediate retiring allowance pursuant to the Members' Retiring Allowances Act other than a reduced allowance pursuant to Section 12A of that Act or an allowance by reason of being totally and permanently disabled.

2 (1) Section 45A of Chapter 1, as enacted by Chapter 9 of the Acts of 2006 and amended by Chapter 40 of the Acts of 2007, Chapter 5 of the Acts of 2009, Chapter 9 of the Acts of 2011 and Chapter 38 of the Acts of 2013, is further amended by adding immediately after subsection (1) the following subsection:

(1A) Subsection (1) does not apply with respect to a general election for which ordinary polling day occurs after the coming into force of this subsection and before January 1, 2018.

(2) Section 45A of Chapter 1 is further amended by adding immediately after subsection (7) the following subsection:

(7A) Notwithstanding subsection (7), no increase in the annual indemnity and salaries shall occur from January 1, 2015, to December 31, 2017, inclusive.

3 Section 48 of Chapter 1 is amended by striking out "a salary of thirty thousand dollars a year," in the first and second lines and substituting "such salary as the Governor in Council from time to time determines".

4 Section 50 of Chapter 1 is amended by striking out "a salary of twenty-five thousand dollars a year" in the first and second lines and substituting "such salary as the Governor in Council from time to time determines".
