Explanatory Note

This Bill permits advertising signs on controlled access highways that were grandfathered by the Advertising Sign Regulations made under Section 49 of the Public Highways Act to be maintained, modified or replaced.

An Act to Amend Chapter 371
of the Revised Statutes, 1989,
the Public Highways Act

Be it enacted by the Governor and Assembly as follows:

1 Section 49 of Chapter 371 of the Revised Statutes, 1989, the Public Highways Act, as amended by Chapter 12 of the Acts of 2001, is further amended by adding immediately after subsection (1) the following subsection:

(1A) Notwithstanding any enactment, advertisements erected on controlled access highways before July 15, 2001, may be maintained, modified or replaced.
