An Act to Prevent
Emergency Room Closures
in Nova Scotia

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Emergency Room Closure Prevention Act.

2 In this Act,

(a) "district health authority" means a district health authority as defined in the Health Authorities Act;

(b) "health district" means a health district as defined in the Health Authorities Act;

(c) "hospital" means a hospital as defined in the Hospitals Act;

(d) "Minister" means the Minister of Health;

(e) "vacancy" means a physician vacancy in an emergency room in a hospital.

3 (1) Subject to Section 6, the Minister shall establish an on-line resource for the purpose of filling physician vacancies in emergency rooms in hospitals.

(2) The on-line resource established pursuant to subsection (1) must

(a) enable district health authorities to report vacancies;

(b) enable physicians to report their availability to fill vacancies; and

(c) enable district health authorities to check the availability of physicians to fill vacancies.

4 Every district health authority shall, within a reasonable time, report to the on-line resource established pursuant to this Act when there will be a vacancy within its health district.

5 (1) The Minister may make regulations respecting any matter or thing that the Minister considers necessary or advisable to carry out effectively the intent and purpose of this Act.

(2) The exercise by the Minister of the authority contained in subsection (1) is regulations within the meaning of the Regulations Act.

6 The moneys required for the purpose of this Act must be paid out of moneys appropriated by the Legislature for that purpose.
