Explanatory Note

This Bill reduces

(a) the period required for tenure from five years to one year; and

(b) the length of time required for the existence of rental arrears before the landlord may give the tenant a notice to quit.

An Act to Amend Chapter 401
of the Revised Statutes, 1989,
the Residential Tenancies Act,
Respecting Security of Tenure
and Arrears of Rent

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 10(6) of Chapter 401 of the Revised Statutes, 1989, the Residential Tenancies Act, is amended by striking out "thirty" in the fourth line and substituting "fifteen".

(2) Subsection 10(8) of Chapter 401, as amended by Chapter 31 of the Acts of 1992, Chapter 40 of the Acts of 1993, Chapter 32 of the Acts of 1994 and Chapter 7 of the Acts of 1997, is further amended by

(a) striking out "eighteenth day of May, 1984," in the second and third lines and substituting "first day of December, 2007,"; and

(b) striking out "five consecutive years" in the fourth line and substituting "one year".
