Explanatory Note

This Bill prohibits the use of a hand-held cellular telephone while operating a motor vehicle.

An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act,
Respecting Cellular Telephones

Be it enacted by the Governor and Assembly as follows:

1 Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, is amended by adding immediately after Section 109 the following Section:

109A (1) No person shall use a hand-held cellular telephone while driving a motor vehicle on a highway.

(2) The Governor in Council may make regulations defining "cellular telephone" and "hand-held" for the purpose of subsection (1).

(3) The exercise by the Governor in Council of the authority contained in subsection (2) is regulations within the meaning of the Regulations Act.

2 Section 292 of Chapter 293, as enacted by Chapter 10 of the Acts of 2002 and amended by Chapter 8 of the Acts of 2005, is further amended by adding ", 109A" immediately after "95" in the fourth line.
