Explanatory Note
This bill permits the City of Dartmouth to withdraw up to $1,050,000.00 from the
Pollution Control Account during the 1995/96 fiscal year without the consent of the Minister and
use that money for any purpose for which the Council has authority to expend money. At present
Council may only use such funds for the control of pollution in Halifax Harbour.
An Act to Amend Chapter 43A
of the Acts of 1978,
the Dartmouth City Charter
Be it enacted by the Governor and Assembly as follows:
1 Section 229B of Chapter 43A of the Acts of 1978, the Dartmouth City Charter, as
enacted by Chapter 58 of the Acts of 1988, is amended by adding immediately after subsection
(4) the following subsection:
(4A) Notwithstanding subsection (4), the Municipal Affairs Act or any other
enactment, the Council may, without the consent of the Minister, withdraw up to one
million fifty thousand dollars from the Pollution Control Account and use such money for
any purpose for which the Council has authority to expend money.
