Explanatory Notes
This Bill clarifies that a child who has suffered physical or
emotional harm caused by being exposed to repeated domestic
violence by or towards a parent or guardian of the child is a child
in need of protective services where the offending parent or
guardian -- not the parent or guardian who has been subjected to
domestic violence --fails or refuses to obtain services or treatment
to remedy or alleviate the violence.

Be it enacted by the Governor and Assembly as follows:
1 Clause 22(2)(i) of Chapter 5 of the Acts of 1990, the Children and Family Services
Act, is amended by striking out "child s" in the fourth line and substituting "offending".
