Explanatory Notes
This Bill permits a grandparent to apply to court for the care and custody of or for access
and visiting privileges in respect of his or her grandchild.
An Act to Amend Chapter 160
of the Revised Statutes, 1989,
the Family Maintenance Act
Be it enacted by the Governor and Assembly as follows:
1 Subsection 18(2) of Chapter 160 of the Revised Statues, 1989, the Family
Maintenance Act, as amended by Chapter 5 of the Acts of 1990, is further amended by striking
out "or guardian" in the second line, in the second line of clause (a) and in the second line of
clause (b) and substituting in each case ", guardian or grandparent".
2 Section 19 of Chapter 160 is amended by adding "or, where a grandparent has
made an application under Section 18, the grandparent" immediately after "guardian" in the last
line.
