Explanatory Notes
Clause 1 amends the definition of "marital status" to include same-sex couples.
Clause 2 adopts language ensuring paramountcy of human rights in Nova Scotia.
An Act to Amend Chapter 214
of the Revised Statutes, 1989,
the Human Rights Act
Be it enacted by the Governor and Assembly as follows:
1 Clause 3(i) of Chapter 214 of the Revised Statutes, 1989, the Human Rights Act, as
enacted by Chapter 12 of the Acts of 1991, is amended by adding "or two persons of the same
sex who are not married but who live together and view each other as spouses" immediately after
"married" in the last line.
2 Section 21 of Chapter 214 is repealed and the following Section substituted:
21 (1) This Act binds Her Majesty in right of the Province and every servant
and agent of Her Majesty.
(2) Every law of the Province is inoperative to the extent that it authorizes
or requires the doing of anything prohibited by this Act unless it falls within an exemption
provided by this Act or unless it is expressly declared by an Act of the House of Assembly
to operate notwithstanding this Act.
(3) An exemption or declaration enacted in accordance with subsection (2)
has effect for no more than five years.
