Explanatory Notes
Clause 1 expands the definition of "prescribed" to include things prescribed under the Change of Name Act or the regulations.
Clause 2 reduces the period during which a person must reside in Nova Scotia before applying for a change of name from one year to three months.
Clause 3 authorizes the Minister of Service Nova Scotia to prescribe the certificates and forms to be used for the purpose of the Change of Name Act.
Clause 4 repeals the authority for the Governor in Council to make regulations prescribing certificates and forms for the purpose of the Change of Name Act.
Clause 5 provides that this Act comes into force upon proclamation.
An Act to Amend Chapter 66
of the Revised Statutes, 1989,
the Change of Name Act
Be it enacted by the Governor and Assembly as follows:
1 Clause 2(g) of Chapter 66 of the Revised Statutes, 1989, the Change of Name Act, is repealed and the following clause substituted:
- (g) "prescribed" means prescribed by or under this Act or regulations;
2 Clause 3(1)(b) of Chapter 66 is repealed and the following clause substituted:
- (b) has been ordinarily resident in the Province for at least three months immediately preceding the application,
3 Chapter 66 is further amended by adding immediately after Section 20 the following Section:
- 20A The Minister of Service Nova Scotia may prescribe the certificates and forms to be used for the purpose of this Act.
4 Clause 21(a) of Chapter 66 is repealed.
5 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
