Explanatory Note

This Bill

(a) removes the authority of the Governor in Council to approve supplementary appropriations and gives that authority to the House of Assembly; and

(b) requires that the Committee of the Whole on Supply consider supplementary appropriations for a maximum of 20 hours.

An Act to Amend Chapter 2
of the Acts of 2010,
the Finance Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 27(3) of Chapter 2 of the Acts of 2010, the Finance Act, is amended by striking out "Governor in Council" wherever it appears and substituting in each case "House of Assembly".

(2) Subsection 27(5) of Chapter 2 is repealed.

2 (1) Subsection 28(3) of Chapter 2 is amended by striking out "Governor in Council" wherever it appears and substituting in each case "House of Assembly".

(2) Subsection 28(4) of Chapter 2 is amended by striking out "Governor in Council" and substituting "House of Assembly".

(3) Subsection 28(5) of Chapter 2 is repealed.

3 The Rules and Forms of Procedure of the House of Assembly are amended by adding immediately after Rule 62G the following Rule:

    62H When the Minister of Finance tables an order respecting an additional appropriation under subsection 27(5) of the Finance Act or respecting a final appropriation under subsection 28(5) of the Finance Act, the procedure under Rules 62B to 62G apply with necessary modifications to the consideration of those orders with the reference to forty hours in Rules 62DB replaced by twenty hours and the additional appropriation may not be referred to the Subcommittee on Supply.
