Explanatory Note
This Bill provides for the consolidation of the trustees for three United Churches in Halifax, namely, Fort Massey United Church, St. Andrew’s United Church and St. Matthew’s United Church.
An Act to Amend Chapter 158 of the Acts of 1919,
An Act to Incorporate the Trustees of
St. Matthew’s Church in Halifax, and to
Consolidate the Trustees of Fort Massey United Church,
St. Andrew’s United Church and St. Matthew’s United Church
Be it enacted by the Governor and Assembly as follows:
1 The title of the Chapter 158 of the Acts of 1919, An Act to Incorporate the Trustees of St. Matthew's Church in Halifax, is amended by striking out "St. Matthew's Church in Halifax" and substituting "Halifax United Church".
2 Sections 1 and 2 of Chapter 158 are repealed and the following Sections substituted:
- 1 The corporation constituted by this Act as enacted in 1919 is continued under the name "Trustees of Halifax United Church" and by that name shall have perpetual succession and a common seal.
2 The persons holding office immediately before the coming into force of this Section as
(a) The Trustees of Fort Massey United Church, Halifax, as constituted by Chapter 79 of the Acts of 1871, An Act to Incorporate the Trustees of Fort Massey Presbyterian Church, Halifax;
(b) the Trustees of St. Andrew's United Church, Halifax; and
(c) The Trustees of St. Matthew's Church in Halifax, as constituted by this Act in 1919,
and their successors in office duly elected by the congregation of Halifax United Church in Halifax, are the Trustees of Halifax United Church as continued by this Act.
2A Any real and personal property vested immediately before the coming into force of this Section in
(a) The Trustees of Fort Massey United Church, Halifax;
(b) the Trustees of St. Andrew's United Church, Halifax; or
(c) The Trustees of St. Matthew's Church in Halifax,
is hereby vested in the Trustees of Halifax United Church, subject to any trusts, restrictions or provisos applying to such real and personal property.
2B All gifts, trusts, bequests, devises and grants of property or income, or proceeds from property purporting to be given to, made to or held in trust for
(a) Fort Massey United Church, Halifax;
(b) St. Andrew's United Church, Halifax; or
(c) St. Matthew's Church, also known as St. Matthew's United Church in Halifax,
whether given, made or held before or after the coming into force of this Section, are deemed to be given to, made to or held in trust by the Trustees for the benefit of Halifax United Church, subject to any restriction or proviso applying to such gift, trust, bequest, devise or grant.
3 Section 6 of Chapter 158 is repealed.
4 Chapter 79 of the Acts of 1871, An Act to Incorporate the Trustees of Fort Massey Presbyterian Church, Halifax, is repealed
5 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
