An Act Respecting
the Sale of Products Containing
Perfluoroalkyl and Polyfluoroalkyl Substances

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Forever Chemicals Prohibition Act.

2 In this Act,

"essential product" means a product containing intentionally added PFAS that is essential for health, safety or the functioning of society and for which an alternative not containing PFAS is not reasonably available;

"intentionally added PFAS" means PFAS deliberately added during the manufacture of a product where the continued presence of PFAS is desired in the final product or one of the product's components to perform a specific function;

"PFAS" means perfluoroalkyl and polyfluoroalkyl substances.

3 On and after January 1, 2028, no person shall sell or offer for sale in the Province any product that contains intentionally added PFAS, unless the product is

(a) a medical device approved by Health Canada; or

(b) an essential product.

4 A person who contravenes this Act is guilty of an offence.
