An Act to Reduce
Interprovincial Trade Barriers
in Atlantic Canada
Be it enacted by the Governor and Assembly as follows:
1 This Act may be cited as the Atlantic Canada Interprovincial Trade Barriers Reduction Act.
2 In this Act, "Atlantic Provinces" means the Provinces of Nova Scotia, New Brunswick, Prince Edward Island and Newfoundland and Labrador.
3 (1) Within six months of the coming into force of this Act, the Government shall, in writing, communicate to the governments of the other Atlantic Provinces the desire of the Government to form an interprovincial trade agreement.
(2) The interprovincial trade agreement under subsection (1) must be designed to
(a) avoid measures that restrict or impair trade between or through the Atlantic Provinces;
(b) ensure that each Atlantic Province treats businesses, investors and workers of the other Atlantic Provinces at least as favourably as it treats businesses, investors and workers in its own jurisdiction and in other jurisdictions;
(c) mutually recognize and reconcile unnecessary differences in regulations;
(d) provide notification between the Atlantic Provinces of proposed regulations to ensure new regulations do not create trade barriers;
(e) create a dispute resolution mechanism that is accessible to the Atlantic Provinces and their businesses, investors and workers; and
(f) meet any other goals that the Atlantic Provinces identify to decrease interprovincial trade barriers and increase economic co-operation.
