An Act to Amend Chapter 77
of the Revised Statutes, 1989,
the Collection and Debt Management Agencies Act
1 Section 5 of Chapter 77 of the Revised Statutes, 1989, the Collection and Debt Management Agencies Act, as enacted by Chapter 40 of the Acts of 2012, is amended by adding immediately after subsection (8) the following subsection:
- (9) Notwithstanding subsections (7) and (8), a collector or a debt management agent may remotely conduct collection agency activity or debt management agency activity, respectively, from a place other than the place authorized by the agency licence if the conditions prescribed by the regulations are met.
2 Subsection 5A(2) of Chapter 77, as enacted by Chapter 40 of the Acts of 2012, is amended by striking out "represent himself or herself as" in the first and second lines and substituting "purport to be".
3 Subsection 6(2) of Chapter 77 is amended by striking out "by him" in the third line.
4 Subclause 20(1)(e)(i) of Chapter 77, as enacted by Chapter 40 of the Acts of 2012, is amended by striking out "he or she" in the second line and substituting "the person".
5 Section 28 of Chapter 77, as amended by Chapter 8 of the Acts of 1998, Chapter 3 of the Acts of 2003 (Second Session) and Chapter 40 of the Acts of 2012, is further amended by adding immediately after clause (a) the following clause:
- (aa) prescribing the conditions under which a collector or a debt management agent may work remotely;
6 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
