An Act to End the Carbon Tax
by Implementing a Cap-and-trade Program
Be it enacted by the Governor and Assembly as follows:
1 This Act may be cited as the Cap-and-trade Program Act.
"cap-and-trade program" means the greenhouse gas emissions cap-and-trade program implemented pursuant to Section 3;
"Minister" means the Minister of Environment and Climate Change.
3 (1) Subject to Section 4, the Minister shall implement a greenhouse gas emissions cap-and-trade program in the Province no later than January 1, 2025.
(2) The cap-and-trade program must
(a) establish greenhouse gas emission reduction targets for the Province; and
(b) provide a mechanism pursuant to which greenhouse gas emission allowances and credits may be created and granted for the purpose of
- (i) contributing to the achievement of the targets established under clause (a), and
(ii) mitigating the costs and impact of reducing greenhouse gas emissions.
(3) The cap-and-trade program must be compliant with, and meet all benchmarks established by, the Pan-Canadian Framework on Clean Growth and Climate Change.
(4) The Minister shall introduce any legislation in the House of Assembly that is necessary to implement the cap-and-trade program.
4 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
