Explanatory Note

This Bill amends the Fair Drug Pricing Act to provide coverage for antiviral drugs for the purpose of pre-exposure prophylaxis from HIV with no copayment.

An Act to Amend Chapter 7
of the Acts of 2011,
the Fair Drug Pricing Act,
to Expand Access to PrEP

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Access to PrEP Act.

2 Chapter 7 of the Acts of 2011, the Fair Drug Pricing Act, is amended by adding immediately after Section 10 the following Section:

    10A (1) Notwithstanding subsection 10(1), antiviral drugs for the purpose of pre-exposure prophylaxis from human immunodeficiency viruses are deemed to be a benefit.

    (2) No copayment may be charged in connection with antiviral drugs for the purpose of pre-exposure prophylaxis from human immunodeficiency viruses.
