Explanatory Notes

Clause 1 requires the Governor in Council to make regulations effective January 1, 2025, respecting

(a) the boundary of the Coastal Protection Zone;

(b) exemptions;

(c) approvals;

(d) designating professionals;

(e) conditions and standards for proposed structures;

(f) permitting or prohibiting activities in the Coastal Protection Zone;

(g) the powers and duties of municipalities respecting permits;

(h) modifications of existing structures; and

(i) infilling.

Clause 2 removes the proclamation clause and substitutes an effective date for the Act.

An Act to Amend Chapter 3
of the Acts of 2019,
the Coastal Protection Act

Be it enacted by the Governor and Assembly as follows:

1 Subsection 28(1) of Chapter 3 of the Acts of 2019, the Coastal Protection Act, is amended by striking out “may make regulations” and substituting “shall make regulations, to be effective on June 1, 2024,”.

2 Section 29 of Chapter 3 is repealed and the following Section substituted:

    29 This Act has effect on and after January 1, 2025.
