Explanatory Note

This Bill changes the threshold for disclosure of personal health information about an individual without the individual's consent where there is a risk of serious harm to the individual or to another person.

An Act to Amend Chapter 41
of the Acts of 2010,
the Personal Health Information Act

Be it enacted by the Governor and Assembly as follows:

1 Clause 38(1)(d) of Chapter 41 of the Acts of 2010, the Personal Health Information Act, is amended by striking out "avert or minimize an imminent and significant danger to the health or safety of any person or class of persons" and substituting "prevent or lessen a risk of serious harm to the patient's health or safety or that of another person".
