An Act to Provide Relief from
Expenses Due to Road Construction
1 This Act may be cited as the Road Construction Relief Act.
2 The purpose of this Act is to provide financial relief to persons and businesses incurring expenses as a result of road construction.
"Minister" means the Minister of Public Works;
"Program" means the Road Construction Relief Program established by this Act;
"road construction" means road construction on a highway to which the Public Highways Act applies.
4 (1) Subject to Section 6, the Road Construction Relief Program is established.
(2) Any person or business that has incurred eligible expenses as a result of road construction may apply to the Program for reimbursement for such expenses.
(3) The Minister shall establish an online portal through which applications may be made to the Program.
(4) Where an applicant meets the criteria prescribed by the regulations and, in accordance with the regulations, provides sufficient evidence that the applicant has incurred eligible expenses, the Minister shall provide reimbursement for the eligible expenses.
5 (1) The Governor in Council may make regulations
(a) defining "eligible expenses";
(b) respecting the manner in which an application may be made to the Program;
(c) prescribing criteria that an applicant must meet in order to receive reimbursement through the Program;
(d) respecting the evidence to be provided by applicants.
(2) The exercise by the Governor in Council of the power contained in subsection (1) is a regulation within the meaning of the Regulations Act.
6 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
